Delivery in 2023 of electricity to facilities managed by public finance sector units as well as state and local government legal entities from the Opolskie and Śląskie Voivodships
The scope of the contract includes:
1. supply of electricity (hereinafter referred to as "EE") to customers from the Opolskie and Śląskie Voivodships, who on 01.03-30.03.2022 authorized the Commune of Kędzierzyn-Koźle to jointly conduct the procedure and award a public contract for the supply of electricity in 2023 to facilities managed by public finance sector units from the Opolskie and Śląskie Voivodships. The order includes the demand for EE for facilities administered by:
- municipal offices and municipal organizational units,
- poviat starosty and poviat organizational units,
- cultural institutions,
- self-governing legal entities,
- other units of the public finance sector.

The scope of the contract includes:
1.supply of electricity (hereinafter referred to as "EE") to customers from the Opolskie and Śląskie Voivodships, who on 01.03-30.03.2022 authorized the Commune of Kędzierzyn-Koźle to jointly conduct a procedure and award a public contract for the supply of electricity in 2023 to facilities managed by public finance sector units from the Opolskie and Śląskie Voivodeships. The order includes the demand for EE for facilities administered by:
- municipal offices and municipal organizational units,
- poviat starosty and poviat organizational units,
- cultural institutions,
- self-governing legal entities,
- other units of the public finance sector.
The Contracting Authority provides for the possibility of exercising the right of option referred to in Article 441 (1) of the Pzp Act covering the possibility of increasing the supply of electricity under the terms of the contract by a further 30% of the basic contract when, after the settlement of the tendering procedure, the will be new energy consumption points or in case of increased demand for electricity supply to PPE listed in Annex 5 to SWZ- Electricity demand _Summary of electricity customers and description of electricity consumption points
The right of option is the power of the Contracting Authority, which it may, but does not have to exercise in the implementation of this Agreement. In the event that the Contractor does not exercise the right of the option, the Contractors shall not be entitled to any claim in this respect. The condition for the activation of the option right is to submit a statement of will by the Contracting Authority to exercise the right of option to the extent specified by it.
2.The contract covers 2320 EE collection points supplying buildings, premises, commercial premises, street lighting, street traffic lights and water, sewage and heating installation equipment.
These facilities, their administrators and EE collection points are described in detail in Annex 5 to the SWZ - Demand for electricity _Zestawienie electricity consumers and a description of electricity consumption points, posted in an electronic version on the website of the proceedings being an integral part of the SWZ.
3.The annual demand for electricity was set at 46 472 372.85 kWh (with the right of option approx. 60,414,084.71 kwh). This is an indicative value, see point 7.
4.The division by types of tariffs is included in Annex 6 to the SWZ - Balance of demand for EE by tariffs.
5. Before the conclusion of a detailed contract or during its term, the Ordering Party reserves the right to choose a different tariff than the one currently in force for a given EE collection point (shown in Annex 5 to the SWZ), provided that the requirements set by the Distribution System Operator (DSO) are met.
6.Na the basis of a general agreement concluded by the Ordering Party with a selected Contractor (EE supplier), detailed contracts will be concluded by individual administrators of facilities in which individual EE collection points are located.
7. Determining the expected consumption of electricity is an element used only to determine the value of the contract and does not constitute an obligation of the Ordering Party to purchase electricity in the given quantities.
8.Each customer listed in Annex 7 to the SWZ List of contracting entities will independently conclude an individual contract for the distribution of electricity.
9.A detailed description of the subject of the contract is specified in the Draft provisions of the contract and attachments placed in an electronic version on the website of the conducted procedure constituting an integral part of the SWZ.
