A detailed description of the subject of the contract is attached as Appendix No. 1 to the Terms of Reference. The provisions relevant to the parties are included in the Model Agreement constituting Appendix No. 2 to the Terms of Reference. If the tender documentation indicates a trademark, a patent, a source, a source or a specific process that characterizes supplies or services provided by a specific Contractor (in particular, the trade name of a form, commodity or product), the Contracting Authority – in relation to the parameters or data (technical or any other) directly or indirectly identified in the tender documentation – directly or indirectly identifying the goods or products – accepts equivalent solutions in accordance with the technical data and parameters contained in point 4 of the Detailed description of the subject of the contract constituting Appendix No. 1 to the Terms of Reference. Equivalent solutions should be understood as solutions characterized by parameters not worse than those required and included in the documentation. If the Contracting Authority describes the subject matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority accepts solutions equivalent to those described by the Contracting Authority, and each such reference shall be provided with "or equivalent". The required terms and conditions, including guarantees and warranties, are set out in Appendix 1 to the Terms of Use and in the Model Agreement – Appendix 2 to the Terms of Reference.
