Comprehensive supplies of natural gas to units subordinate to the Provincial Police Headquarters in Łódź

1. The subject of the contract is the supply of high-methane natural gas type E (GZ-50) at a pressure not lower than 1.6 kPa, with parameters consistent with the Energy Law, including the sale and distribution of gas to units subordinate to the Provincial Police Headquarters in Łódź for a period of 24 months, to the point of consumption through the existing connection, the entry point to the gas system – a gas reduction station located on the Contracting Authority's plot.

2. The contracting authority shall provide for a reverse procedure in accordance with Article 139(1) of the uPzp.

3. In view of the application of the procedure in Article 139 (1), the Contracting Authority shall not require the submission with the offer of the declaration referred to in Article 125 (1UPzp. The Contracting Authority will only request this statement from the contractor whose offer will be rated at the highest.

4. Pursuant to Article 257(1) of the Public Procurement Law, the Contracting Authority reserves the right to cancel the procedure if the public funds that the contracting authority intended to allocate to finance all or part of the contract are not granted to it.

KPP Wieluń / 22a Warszawska Street

1. The Ordering Party informs that as a Recipient it is classified to the seller's tariff group: for lot 1 (KPP Wieluń) - G-2

2. The expected consumption of gaseous fuel for central heating and hot water purposes during the term of the agreement set out in the Price Form – Appendix No. 2 to the Terms of Reference amounts to 1,359,237.75 kWh and is an estimated (forecast) value, resulting from the actual gas consumption to date in the period of 12 months from 01.07.2022 to 30.06.2023 (used for the purpose of comparing offers), which may change during the course of the order.

3. The Contracting Authority reserves the right to reduce or increase the total amount of gas in relation to the quantity specified in the Price Form – Appendix No. 2 to the Terms of Reference. Any change in the estimated consumption will not result in additional costs for the Ordering Party, apart from the settlement for the amount of gas actually consumed.

4. During the term of the contract, the Contractor shall supply natural gas in an amount corresponding to the actual demand of the Contracting Authority, regardless of the estimated forecast of its consumption.

5. Any change in the estimated consumption will not result in additional costs for the Ordering Party, apart from the settlement for the amount of gas actually consumed.

6. Settlements for the distribution of natural gas will be based on current indications of the metering systems.

7. The minimum estimated quantity of deliveries that the Contracting Authority intends to make will not be less than 70% of the quantity specified in point 2 of the Draft Provisions of the Agreement – Appendix No. 8 to the Terms of Reference, which cannot be the basis for claims on the part of the Contractor.

8. Natural gas will be supplied on the basis of an agreement containing the provisions of the sales agreement and the agreement for the provision of gas distribution services in accordance with the applicable law, in particular under the terms and conditions set out in the Energy Law of 10 April 1997 (i.e. Journal of Laws of 2022, item 1385, as amended) and the implementing regulations to the Act and the Act of 16 February 2007 on crude oil stocks, petroleum products and natural gas, as well as the rules of conduct in situations of threat to the fuel security of the state and disruptions on the petroleum market (i.e. Journal of Laws of 2020, item 411).

9. Gas supply fees will remain unchanged throughout the term of the agreement, while distribution fees will be charged in accordance with the distribution operator's tariff approved by the President of the Energy Regulatory Office.

10. The Contractor is obliged to carry out the procedure of changing the supplier before the date of commencement of deliveries to the Contracting Authority's building, i.e. to submit on behalf of the Contracting Authority to the Distribution System Operator (DSO) an application for notification of a change of supplier, in accordance with the Distribution Network Operation and Operation Manual (IRiESD) with respect to the provision and use of natural gas distribution services. Applications should be submitted in time to make an effective change before the date of commencement of deliveries to the Contracting Authority's building. The Contractor shall bear all liability arising from failure to comply with this obligation.

11. The ownership of the gaseous fuel is transferred to the Contracting Authority within the ownership of the DSO's gas network specified in the terms and conditions of connection to the gas network.

12. Under the agreement, gas quality standards will apply in accordance with Chapter 8 "Quality parameters of gaseous fuels, quality standards of customer service and method of handling complaints" of the Regulation of the Minister of Economy of 2 July 2010 on detailed conditions for the operation of the gas system (i.e. Journal of Laws of 2018, item 1158).

KP Głowno / ul. Ludwika Norblina 3
