The subject of the contract are updates of e-learning courses along with the development and maintenance of the Platform.

1. The subject of the contract are updates of e-learning courses along with the development and maintenance of the Platform.

2. As part of the implementation of the subject of the Agreement, the Contractor shall perform the following tasks:

2.1. Task No. 1 - Platform development service and e-learning training posted on the Platform (hereinafter referred to as "UR"), for:

a) the SOW System implemented under the project entitled "Support service system financed from PFRON funds" under the Operational Programme Digital Poland 2014-2020, Priority Axis 2 "E-administration and open government", Measure 2.1 "High availability and quality of public e-services" (hereinafter referred to as the "SOW System");

b) the iPFRON+ System implemented as part of the project entitled "Universal platform for the design and implementation of support programs ON together with an integrated analytical module - iPFRON+ System" under the Operational Programme Digital Poland 2014-2020, Priority Axis 2 "E-government and open government", Measure 2.1 "High availability and quality of public e-services" (hereinafter referred to as the "iPFRON+ System").

.2.2. Task No. 2: Platform maintenance service (hereinafter referred to as "ATiK").

3. Details and conditions for the implementation of the subject of the contract are included in Annex 1 to the SWZ (hereinafter referred to as "OPZ").

4. The terms and conditions of the contract performance are also included in the draft provisions of the public procurement contract, which will be introduced into the content of the contract constituting Annex 2 to the SWZ (hereinafter referred to as "PPU").

5. The Contracting Authority requires the Contractor or Subcontractor to employ on the basis of an employment contract a person/persons performing all activities related to the supervision of the Agreement, in particular in the scope of cooperation with the Contracting Authority in order to manage the Agreement on an ongoing basis and monitor the proper implementation of works and services, all correspondence, notifications related to the implementation of the Agreement, including signing Acceptance Protocols, the performance of which consists in performing work in the manner specified in Article 22 paragraph 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320 with subsequent amendments).

6. Details regarding the method of documenting employment and controlling the Contractor's or Subcontractor's compliance with the requirements for employment under an employment contract and provisions regarding sanctions for failure to meet the above-mentioned requirements shall be included in the provisions of the PPU.

7. The estimated value of the contract as defined in section II.1.5) of this notice is the total estimate, including:

7.1. guaranteed order – net PLN 575,345.00;

7.2. orders under the Option – net PLN 575,345.00;

7.3. orders referred to in Article 214(1)(7) of the PPL Act – net PLN 287,672.50.

8. The deadline for the implementation of the Subject of the Agreement – a maximum of 48 months from the date of conclusion of the Agreement, but not earlier than from 01.09.2023, including:

8.1. Development of the Platform and e-learning Training posted on the Platform (Task No. 1) – will be provided throughout the entire period of the Agreement, but no longer than until the last day of ATiK (Task No. 2), regardless of whether ATiK will be provided under a guaranteed order or an Increasing Option;

8.2.Us maintenance of the Platform (Task No. 2) – 24 months under the guaranteed order and a maximum of another 24 months under the Increasing Option.

9. Details regarding the deadlines for the implementation of individual activities under the Tasks and the conditions for the implementation of the Subject of the Agreement can be found in the OPZ and PPU.

10. The contracting authority informs that, pursuant to Article 139 of the Act, it will first examine and evaluate the bids, and then it will make a subjective qualification of the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. Pursuant to Article 139(2) of the Public Procurement Law, the Contracting Authority shall demand the declaration referred to in Article 125(1) of the PPL only from the Contractor whose bid was rated the highest.
