REMARK!! Failure to fill in column 3 of the above-mentioned specifications (Annex 1A) or proposing products inconsistent with the requirements of the Contracting Authority shall be tantamount to rejecting the Contractor's offer pursuant to Article 226(1)(5) of the PPL Act – as inconsistent with the terms of the contract.
3 In order to confirm that the offered supplies meet certain requirements, the Contracting Authority requires the Contractor to submit product cards or other documents together with the offer, from which their composition and fulfillment of the requirements specified by the Ordering Party in the Assortment-Quantity-Value Specification constituting Annex 1A to the SWZ will be derived.
4. The given quantities are estimates and do not oblige the Ordering Party to purchase products in these quantities.
5. The Contracting Authority reserves the possibility of not fulfilling the object of the order worth up to 50% of the total gross remuneration No financial and legal claims are entitled to the Contractors due to the failure of fulfilment of part of the contract.
6. Delivery, unloading and placing of the object of the contract shall be carried out at the expense of the Contractor as calculated in the price of the products covered by the public contract award contract.
7. Delivery of the object of the contract shall be carried out by means of transport of the Contractor authorized for the transport of food
8. Delivery persons must be entitled to the current medical judgment for sanitary and epidemiological purposes, which they show at the request of the Ordering Party.
9. The Contractor is obliged to have a current certificate of entry in the register of establishments subject to official control of the competent authorities - in accordance with the Act of 25 August 2006 on food and nutrition safety (i.e. Journal of Laws of 2022, item 2132)
or a current administrative decision on entry in the register of establishments or on approval of the establishment issued by the district veterinarian together with the assigned identification number in accordance with Article 21 paragraph 4 of the Act of 16 December 2005 on products of animal origin (i.e. Journal of Laws of 2020, item 1753, as amended). The developer must be subject to constant supervision by the competent authorities.
10. The offered products must meet the requirements set out in the applicable laws on the production and marketing of food. Each product must be manufactured and placed on the market in accordance with the requirements of the HACCP system.
11. The details of the delivery are specified in the model contract constituting Annex 5 to the SWZ.
12. The Contractor shall ensure the protection of the transferred personal data, in accordance with the Act of 10 May 2018 on the protection of personal data (i.e. Journal of Laws of 2019, item 1781) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as GDPR) (Journal of Laws of the Republic of Poland). EU L 2016 No. 119 p. 1). The obligation to inform Subcontractors, third parties and consortium members about the processing of personal data rests with the Contractor. The Contractor's statement on the fulfillment of the obligations arising from Article 13 or Article 14 of the GDPR towards natural persons from whom personal data it directly or indirectly obtained in order to apply for this contract will be submitted in the offer form – constituting Annex 1 to the SWZ.
