The subject of the contract is the granting or provision of a license/subscription to the Contracting Authority by the Contractor for Microsoft or equivalent software and Software Assurance support packages or equivalent.
A detailed description of the subject of the contract, in particular quality requirements and conditions for the performance of the basic contract and the contract under the option right, is indicated in the annex to the SWZ – Draft contract and in Annex 1 to the Draft contract – Detailed description of the subject of the contract (SOPZ) and in Annex 7 to the SWZ – Draft contract.
The subject matter of the contract is the granting or provision by the Contractor of a license/subscription for Microsoft software or equivalent and Software Assurance or equivalent support packages as described below (Table 1):

A detailed description of the subject matter of the contract, in particular the quality requirements and conditions for the performance of the contract, is indicated in the appendix to the Terms of Reference – Draft contract and in Appendix 1 to the Draft contract – Detailed description of the subject matter of the contract (SOPZ).
Conditions of equivalence: The Contracting Authority allows the delivery of software equivalent to the one indicated in point 3.2. with the proviso that the Contractor must prove that the equivalent solution meets the requirements of the Contracting Authority specified in Chapter II, points 3-5 of Annex 1 to the draft contract – detailed description of the subject of the contract (SOPZ). The Contracting Authority shall consider that the offered software is equivalent to the software indicated in point 3.2. if the Contractor attaches to the offer (in the form of an attachment to the Offer Form) a statement of the equivalent software manufacturer, which clearly confirms all the requirements indicated in Chapter II, points 3-5 of Annex 1 to the draft contract – Detailed description of the subject of the contract (OPZ). The statement referred to above is not subject to supplementation, which means that failure to attach the indicated statement, errors in the statement or failure to confirm compliance with any of the requirements set out in Chapter II, points 3-5 of Annex 1 to the draft contract – SOPZ, in the case of offering an equivalent product, will result in the rejection of the Contractor's offer (legal basis: Article 226 paragraph 1 point 5) of the Public Procurement Law).
