1. The subject of the contract is the supply of electricity in the period from 01.01.2023. until 31.12.2023 up to 1 644 collection points (PPE) with a total estimated volume (+/-10%) of 10 956.48 MWh, of which:
1) For premises and facilities (Part 1 of the order) – 5 694.21 MWh – a detailed list of PPE is attached as Annex 1a to the SWZ
2) For the purposes of road lighting (Part 2 of the contract) – 5 262.27 MWh – a detailed list of PPE is attached as Annex 1b of the SWZ.
2. The forecast electricity consumption indicated above is indicative and may deviate from the amount of energy actually collected, during the duration of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the contracting (customers), other than the need to pay for the amount of energy actually collected.
3. Applicable billing periods: Tariff group B, C2x – 1 month, Tariff group C1x, G, R – 2 months
Supply of electricity to premises and facilities1. Number of measurement systems accounting for consumed electricity 480 pcs
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract – 5 694.21 MWh, of which:
Zone I 3 545,39 MWh
Zone II 2 110,82 MWh

4. Deliveries will take place from 01.01.2023. until 31.12.2023, details of delivery dates for individual collection points are described in Annex 1a to the SWZ column "Delivery period".
5. Measurement systems with tariff group B are tailored to the seller's change procedure.
6. The Ordering Party of the Municipality of Topólka has the status of the Manufacturer - Item No. 3 (number 590243896005982071) in Annex 1a to the SWZ, the ordering party from February 2022 has the installation of photovoltaic panels with a capacity of 11.40 kWp. The contracting authority provides for the conclusion with the contractor, whose offer will be selected, of a contract for the resale and balancing of energy generated in a RES micro-installation and not used (about 0.50 MWh per year), which will be valid for the entire delivery period. The contracting authority agrees to conclude a contract for the resale of energy on the model used by the contractor.
7. The current electricity supply contracts will expire or terminate with effect on the day prior to the scheduled start date (“Supply Period” column). The obligation to terminate contracts is on the side of the contracting (recipients).
8. Quality standards
1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.
2) Quality standards of electricity are described in the Ep and the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system (as amended) and the Regulation of the Minister of Energy of 6 March 2019, as amended, on detailed rules for the formation and calculation of tariffs and settlements in electricity trading.

10. The Contractor, based on the Power of Attorney granted, will be obliged to submit contracts on behalf of himself and the ordering party (recipients) to the competent DSO in accordance with applicable regulations and to represent the ordering party (recipients) before the DSO - the process of changing the seller.
11. The contracting authority reserves the right to use Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer was the highest rated, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
12. As a result of the outcome of the public procurement procedure, 16 contracts will be concluded.
13. The contracting authority requires the provision of a security for the proper performance of the contract, the contractor shall lodge 16 securities for the proper performance of the contract, separately for each contract concluded with the contracting authorities.
14. The Ordering Party requests the payment of a security deposit. In the case of submitting an offer for Part 1 of the order: PLN 200,000.00
Supply of electricity for the needs of road lighting1. Number of measuring systems accounting for consumed electricity 1 164 pcs.

4. Deliveries will take place from 01.01.2023. until 31.12.2023, with the proviso that the details of delivery dates (start and end) for individual collection points are described in Annex 1b to the SWZ column "Delivery period".
5. Current electricity supply contracts will expire or terminate with effect from the day preceding the planned delivery start date (column 'Delivery period'). The obligation to terminate the contracts lies with the contracting authorities (recipients).

8. The Contractor shall, on the basis of the Power of Attorney granted, be required to notify on behalf of the Contractor (s) of the contracts to the relevant DSO in accordance with the applicable rules and to represent the Contracting Party (s) before the DSO - the process of changing the seller.
9. The Contracting Authority reserves the right to make use of Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer has been rated the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure.
10. As a result of the settlement of the procurement procedure, 16 contracts will be concluded.
11. The contracting authority requires the provision of a security for the proper performance of the contract, the contractor shall lodge 16 securities for the proper performance of the contract, separately for each contract concluded with the contracting authorities.
