1. The subject of the order is the delivery of pharmaceutical products divided into 33 packages.
The listed pharmaceutical products are described in detail in Annex 7 to the ToR. The quantities given are the average annual demand over 12 months. The contracting authority allows the possibility of changing the quantity of ordered medicinal products and medical devices, provided that the value of the signed contract cannot be increased. The actual demand will result from the current needs of the Employer.
2. Pharmaceutical products which are the subject of the order should be understood as medicinal products within the meaning of the Pharmaceutical Law of September 6, 2001 (consolidated text: Journal of Laws of 2017, item 2211, as amended). The medicinal products offered must be authorized on the basis of principles specified in art. 3 or 4 paragraph 1 and 2 or 4a of the Pharmaceutical Law.
The Contractor, when offering a medicinal product, food for special nutritional uses, a medical device on the list of reimbursed drugs, when calculating the price, must take into account the provisions of Art. 9 item 2 of the Act of 12.5.2011 on reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws No. 122, item 696), valid as at the day of submitting offers. In addition, account should be taken of the clarifications regarding Article 9 paragraph 2 contained in the communication of the Minister of Health of 26.3.2012 (letter MZ-PLR-460-12576-160 / KB / 12).
