Reconstruction, renovation and extension of Primary School No. 66 together with the necessary infrastructure and land development, construction of an outdoor pitch along with the construction and reconstruction of pedestrian and road routes and reconstruction of the existing internal and external gas, water, sanitary, rainwater, electrical and teletechnical sewage systems at 16/18 Przepiórki Street in Warsaw
The Contracting Authority provides for the application of Article 139 of the Public Procurement Law of 11 September 2019 (i.e. Journal of Laws of 2022, item 1710), hereinafter referred to as the "PPL Act".
1. Order item.
1.1. The subject of the contract is the execution of construction works as part of the task entitled: Reconstruction, renovation and extension of Primary School No. 66 together with the necessary infrastructure and land development, construction of an external pitch along with the construction and reconstruction of pedestrian and road routes and reconstruction of the existing internal and external gas, water, sanitary, rainwater, electrical and teletechnical sewage systems at 16/18 Przepiórki Street in Warsaw.
1.2. The material scope of the subject of the contract includes the modernization and extension of the primary school No. 66 at Przepiórki 16/18 Street in Warsaw, i.e. reconstruction, expansion, renovation along with the necessary infrastructure and land development, including: construction of an external playground, construction and reconstruction of pedestrian and road routes, reconstruction of existing internal and external installations, gas, water, electrical and teletechnical installations, sanitary and rainwater sewage.
1.2.1. The detailed material scope of the Subject of the Agreement is specified in the executive construction project constituting Annex 2 and the Technical Specification for the execution and acceptance of construction works constituting Annex 3 to this Agreement.
1.2.2. The investment task is divided into three stages:
(a) Step 1. Construction of a new wing of the school with connectors enabling communication with the existing school building and land development marked in green (B1) in the construction project.
(b) Step 2. Renovation and modernization works in the front building standing parallel to Przepiórki Street consisting in adapting sanitary facilities and rooms to modern regulations and technical conditions (construction design - red B3). Note: All renovation work on the existing school building must be done during the summer break. The contractor will secure an adequate number of employees in the construction, sanitary and electrical industries to perform the work at the above time.
(c) Step 3. Modernization, reconstruction and extension of the existing lower wing of the school consisting in adapting the facility to modern needs (construction project - blue B2).
2. Requirements related to the execution of the contract concerning employment by the Contractor or Subcontractor of persons on the basis of employment relationship (Article 95 Public Procurement Law).
2.1. The Contractor or subcontractor throughout the entire period of performance of the Subject of the Contract is obliged to employ, employee(s) directly performing work on the construction site, employed under a contract of employment. Activities performed by employees will consist in performing work in the manner specified in article 22 § 1 of the Act of 26.06.1974 – Labor Code (i.e. Journal of Laws of 2019, item 1040, as amended). The type of activities necessary for the performance of the order by persons employed under an employment contract are works related m.in: demolition construction works, finishing works, assembly of sanitary installations, installation of electrical installations, installation of window and door joinery, etc.

The contracting authority does not provide for the award of contracts referred to in Article 214(1)(7) of the PPL Act.
