Successive supply of medicinal products and glukometer strap tests for the needs of the District Health Centre Sp. z o.o. in restructuring in Otwock

The subject of the order is the successive delivery of medicinal products and glucometer strap tests for the needs of the District Health Centre Sp. z o.o. in restructuring in Otwock. For a detailed description of the item of the order, see Annex 1A to SWZ. Proceedings were divided into 46 packages (tasks).

Medicinal products I

1. The exact scope of the object of the contract is described in Annex 1A to SWZ, i.e., the assortment form - price, i.e. connector No 1A.

2. The Contractor may offer only medicinal products authorised in Poland in accordance with the provisions of the Act of 06 September 2001. Pharmaceutical law (Journal of Laws 2001, No. 126, item 1381, as amended) applies to packages (tasks) which are medicinal products.

3. Offers must comply with Article 9 of the Act of 12 May 2011 on reimbursement of medicines, foodstuffs for special nutritional purposes and medical devices (Journal of Laws of 2011, No. 122, item 696 as amended).

4. The Contracting Authority shall require that the goods delivered have information on the packaging on the date of usefulness/expiry date, provided that the expiry date shall not be less than 12 months from the date of delivery.

5. In view of the specifics of the object of the contract and the inability to predict the actual demand, the Contracting Authority reserves the right to transfers in the material and quantitative scope of the goods, provided that the amendments made may not result in exceeding the amount of the financial liability specified in the offer and the contract concluded.

6. The Contracting Authority shall require the duration of the completion of the supplementary order and the replacement of the goods defective or incompatible with the contract to be not more than 48 hours from the time of notification by the Contracting Authority.

7. Date of execution of the order: 12 months from the date of signing the contract

8. Orders will be completed successively, in accordance with the current demand of the Ordering Party up to 2 working days from the date of the order being sent.

9. List of statements made with the offer:

1) Declaration of the absence of grounds for exclusion from proceedings made in the form of a Single European Procurement Document (JEDZ) - according to the model set out in Annex 2 to SWZ.

(a) The declaration constitutes a preliminary confirmation that the contractor is not subject to exclusion and fulfils the conditions for participation in the proceedings as appropriate as at the date of submission

(b) A declaration shall be made by each of the contractors jointly applying for a contract award.

The statement is intended to demonstrate a lack of grounds for excluding each of the contractors.

10. Requirements to be met by two or more entities (Contractors applying jointly for contract award e.g. consortia, civil companies):

1) The Offer must be signed in such a way that it legally obliges all Contractors jointly applying for the award of the contract.

2) Contractors acting jointly shall establish a proxy to represent them in the award procedure or to represent them in the proceedings and conclude a public procurement contract.

3. Any correspondence and settlement shall be made only with the entity acting as a representative of the others.

Glucometer strap test

2. The Contractor may offer only devices that have been placed on the market in accordance with the provisions of the Act of 20 May 2010 on Medical Devices (Journal of Laws of 2020, item 186) — concerns Task No 15 (Gliucometer Strap Test).

3. Offers must comply with Article 9 of the Act of 12 May 2011 on reimbursement of medicines, foodstuffs for special nutritional purposes and medical devices (Journal of Laws of 2011, No. 122, item 696 as amended).

4. The Contractor is obliged to provide the product's trade name, manufacturer's name and catalogue number for each medical device offered (Annex No 1A to SWZ — assortment - price form). In the case of a catalogue number for a given assortment item, you must enter a notification of the number — Task No 15 (Gliucometer Strap Test).

5. The Contracting Authority shall require that the goods delivered have information on the package about the date of usefulness/expiry date, provided that the expiry date shall not be less than 12 months from the date of delivery.

6. In view of the specifics of the object of the contract and the inability to predict the actual demand, the Contracting Authority reserves the right to transfers in the tangible and quantitative scope of the goods, provided that the amendments made may not result in exceeding the amount of the financial liability specified in the offer and the contract concluded.

6. The Contracting Authority shall require the duration of the completion of the supplementary order and the replacement of the goods defective or incompatible with the contract to be not more than 48 hours from the time of notification by the Contracting Authority.

7. Date of execution of the order: 12 months from the date of signing the contract

8. Orders will be completed successively, in accordance with the current demand of the Ordering Party up to 2 working days from the date of the order being sent.
