1) The subject of the contract is the maintenance of green areas of the Ursynów District – Kasztanowa Avenue, "ZŁOTÓWKI" Square in the area of Ekologiczna - Polna Róży, Zieleniec at Sępa Szarzyńskiego Street, with a detailed description of the subject of the contract specified by:
- Description and technical standards of the subject of the contract - Annex 1 to the SWZ;
- Designed provisions of the contract, annex 5 to the SWZ;
- Price form constituting Annex 9 to SWZ;
Obligations under the social clause:
The contracting authority in the proceedings in question applies a social clause pursuant to Article 95(1) of the Act

Details of point 7 of the SWZ
1) The subject of the contract is the maintenance of green areas of the Ursynów District – Kasztanowa Avenue, "ZŁOTÓWKI" Square in the area of Ekologiczna - Polna Róży, Zieleniec at Sępa Szarzyńskiego Street, with a detailed description of the subject of the contract specified by:
- Description and technical standards of the subject of the contract - Annex 1 to the SWZ;
- the proposed provisions of the contract constituting Annex 5 to the SWZ;
- Price form constituting Annex 9 to SWZ;
2) Obligations under the social clause
1. The contracting authority shall apply a social clause in the proceedings in question pursuant to Article 95(1) of the Public Procurement Law.
2. The Contractor undertakes that the activities in the field of performance of the contract for services, during the entire period of performance of the subject of the contract, will be performed by persons employed on the basis of an employment contract within the meaning of the Labor Code by the Contractor or Subcontractor.
3. The condition referred to in paragraph 2 shall be fulfilled by the employment of new employees on the basis of an employment contract or the appointment of already employed persons who perform the activities indicated below during the execution of the contract, i.e.: the work consisting in emptying baskets and mowing lawns.
4. Detailed requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Act, in particular the method of verifying the employment of persons under an employment contract, the Contracting Authority's rights to control the Contractor's compliance with the above-mentioned requirements and sanctions for non-compliance with them are specified in the draft provisions of the contract constituting Annex 5 to the SWZ.
3) SIMILAR ORDERS:
The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law with a total value of up to PLN 320,000.00 net consisting in: care of greenery and maintenance of cleanliness. The contract will be awarded provided that the Ordering Party has the necessary financial resources and will be implemented on the basis of the basic agreement.
4) SUBCONTRACTING
(a) The Contracting Authority shall not reserve the personal performance by the Contractor of key parts of the The Contractor may entrust execution of part of the contract to the subcontractor
(b) The Contractor is obliged to indicate in the offer the parts of the contract whose execution he intends to entrust to the subcontractors and provide the names of possible subcontractors if they are already known.
(c) Where the modification or resignation of a subcontractor relates to an entity whose resources the contractor relied on, under the rules laid down in Article 118 (1), in order to demonstrate that the conditions of participation in the proceedings are fulfilled, the contractor shall demonstrate to the contracting authority that another subcontractor proposed or the contractor independently satisfies them to a degree not less than the subcontractor whose resources the contractor relied upon during the procurement procedure. Article 122 of the Pzp Act shall apply accordingly.
