Works contract for the renovation and extension of the swimming pool of Marchienne-au-Pont-LOT 2

Works contract for the renovation and extension of the Marchienne-au-Pont swimming pool. It includes the following work (non-exhaustive list):

-Residual asbestos removal "phase 2";

-Partial demolition of the existing building;

-Renovation of the building;

-Construction of 2 extensions (front façade for circulation areas and west for a learning pool);

-Maintenance and servicing for 2 years of certain technical equipment;

-Development of the surroundings and access roads.

Within the framework of this contract, the Charleroi Municipal Administration wishes to promote professional integration by carrying out an effort of training, integration or socio-professional integration. The attention of tenderers is drawn to the fact that these Special Terms of Reference contain anti-social dumping clauses (accompanied by significant special penalties) developed within the framework of the Strategic Development Committee of the Charleroi and South Hainaut Region. They are highlighted in grey in the C.S.CH. Consequently, tenderers are strongly invited: - to take this into account in the preparation of their tender, the Contracting Authority giving itself the means to verify the conformity of the site with them and to sanction in the event of infringement; - to complete and attach to the offer the Declaration on honour relating to the social anti-dumping clauses annexed to these Special Specifications. The absence of a declaration attached to the tender or a declaration attached but not completed will be considered as revealing the intention of non-compliance with the clauses against social dumping and, consequently, considered as a substantial irregularity.

The execution of this project will include a BIM methodology, developed in the BIM protocol (attached and an integral part of the CSC).

The content of the contract and its general execution context are developed in the technical part of the specifications.

1. Flexible social clause

Pursuant to Article 87 of the Law of 17 June 2016 on public procurement, the successful tenderer undertakes to conduct, as part of the performance of the contract:

- or the training on the site covered by the contract of one or more trainees or learners engaged under a training contract eligible for the social clause.

This requirement will be met by using professional training to be chosen from the different types of training offered in Annex 1 of these special specifications, or a more recent version published on the Public Procurement Portal (marchespublics.wallonie.be/home/outils.html), for a period of 6144 hours over the entire duration of the site.

- or actions for the social and professional integration of disabled people or people who are far from employment.

This requirement will be met by subcontracting to one or more social integration economy enterprises (Integration Company, Socio-Professional Integration Centre or Adapted Work Company) within the meaning of Article 59 of the Law of 26 March 1999 on the Belgian Action Plan for Employment 1998, for 3% of the amount excluding VAT of the approved offer.

- or a combination of the two actions listed above.

This requirement will be met subject to the application of the procedures described in these special specifications.
