Description:
Successive supplies of natural gas along with distribution for the needs of State Administration Units

The subject of the order are successive supplies of natural gas along with distribution (high-methane natural gas with the symbol E) for the needs of State Administration Units, specified in Annex 1 to the ToR. The commencement of natural gas supplies referred to in paragraph 1 will take place not earlier than after successful termination of the current comprehensive agreements for the sale of gas with current sellers. The gas supply will take place on the basis of contracts containing the provisions of the sales contract and the contract for the provision of gas distribution services (comprehensive contract) and will be carried out under the terms of the Act of 10 April 1997 Energy Law (i.e. Journal of Laws of 2019. item 755), the Act of 23 April 1964 Civil Code (i.e. Journal of Laws of 2019, item 1145) and executive acts to the abovementioned laws.

1 / The subject of the order is the successive supplies of natural gas along with distribution (high-methane natural gas with the symbol E) for the needs of the State Administration Units specified in Annex 1 to the ToR.

2 / Beginning of the natural gas supply referred to in para. 1 will take place not earlier than after successful termination of the current comprehensive agreements for the sale of gas with current sellers.

3 / The gas supply will take place on the basis of contracts containing the provisions of the sales contract and the contract for the provision of gas distribution services (comprehensive contract) and will be carried out under the conditions set out in the provisions of the Energy Law of 10 April 1997 (i.e. item 755), the Act of 23 April 1964 Civil Code (i.e. Journal of Laws of 2019 item 1145) and executive acts to the abovementioned laws.

4 / Gas deliveries will be made to gas take-off points ("PPG"), used to connect internal networks owned by the State Administration Units with the gas network of the system operator.

5 / A detailed list of gas intake points, tariff groups, contracted capacity and the planned quantity of gas consumption are set out in Annex 4 to the ToR, which is also a price form.

6 / The indicated values in the list referred to in para. 5 (Annex No. 4) were adopted to calculate the estimated value of the order and are only indicative, which does not reflect the real or declared use of gas during the term of the contract and does not constitute an obligation for the Units to purchase natural gas in the amount provided. The Contractor shall not be entitled to any claim for failure to collect the expected amount of gas by the Employer.

7 / Units will have the right to notify a new gas intake point, while the price rates offered by the Contractor in the offer shall also apply to new gas intake points.

8 / Units will have the right to resign from the gas collection point (PPG) due to e.g. change in location (address) of the Unit or its organizational unit and thus the gas collection point.

Deadline for the contract: 24 months from the date of the contract or from the moment of entry into force of the procedure to change the current gas seller or until the funds allocated to the contract are exhausted by the Unit - whichever occurs first.

The contract will be concluded for a period of 11 months from 01.10.2021.
