The Contracting Authority provides for the application of Article 139 of the Law of 11 September 2019 Public Procurement Law (i.e. Journal of Laws of 2021, item 1129 as amended) hereinafter referred to as the “Pzp Act”.

INFORMATION CLAUZULE ABOUT PERSONAL DATA ON THE RIGHT PROVISIONS is contained in SWZ part. VII point 2.

Estimated net contract value includes the value of the basic contract and anticipated similar orders (Article 214 (1), point 7 of the Pzp Act).

1. Order item.

1.1. Cleanup works on undeveloped areas in the possession of Warsaw in the District of Italy in 2023.

1.2. CPV tasks- 90600000-3 (cleaning services and sanitation services in urban or rural areas and related services); 90511300-5 (garbage collection services).

1.3. The scope of work consists in:

1.3.1. cleaning, removal of outstanding impurities, including papers, foils, cans, bottles, etc. from lawns and other grounds, together with the Contractor's collection and transfer for disposal, under the rules in accordance with the provisions of the Waste Act of 14 December 2012;

1.3.2. mowing of grass and weeds and surface collection of plant waste, of the type: weeds, grass, leaves together with their export and transfer by the Contractor for disposal, under the rules in accordance with the provisions of the Waste Act of 14 December 2012;

1.3.3. disposal of bags with garbage, large waste, branches, etc., and disposal of municipal waste bags under actions such as 'Cleaning the World', Earth Feast, etc., together with the transfer by the Contractor for disposal, under the rules in accordance with the provisions of the Waste Act of 14 December 2012;

1.3.4. removal of concrete, wooden elements, residues of post-construction buildings up to 2 m height of gazebo type and liquidation of foundations, wooden elements, fences, setting and repair of fences, etc. together with their loading, export and transfer by the Contractor for disposal, rules in accordance with the provisions of the Waste Act of 14 December 2012;

1.3.5. elimination of excess land, planting and leveling of the land mechanical or manual, removal of contaminated land together with grilling, raking, transfer by the Contractor for disposal, on the basis of the rules in accordance with the provisions of the Waste Act of 14 December 2012;

1.3.6. the carrying out of other work related to the cleaning of undeveloped areas in the authority of Warsaw indicated by the Contracting Authority (including the reception of tyres of motor vehicles) — cleanup work in accordance with the emerging needs together with the receipt of waste generated at carrying out the work together with the collection and transfer by the Contractor for disposal under the rules in accordance with the provisions of the Waste Act of 14 December 2012.

1.4. Location: The areas of the district of Italy city of Warsaw, the detailed location of services, will be specified in the protocols of introduction according to current needs.

1.5. Undeveloped area, which is in the possession of the city of Warsaw — the area indicated by the Ordering Party - contaminated with rubbish and above-normal waste, overgrown with grass, weeds, self-settlements.

1.6. The Contractor shall be obliged to perform the order correctly:

1.6.1. to have employees of a minimum of 4 persons - equipped with clothing with the company logo necessary for the proper implementation of the work related to the clean-up of the sites indicated each time in the protocol of introduction,

1.6.2. for the duration of the execution of the contract allocate at the disposal of the District of Italy a worker for supervision of the proper performance of the work, having experience in the scope of the contract.

1.6.3. disposal of equipment in the assortment and the number needed to carry out the scope of work arising out of the contract.

1.7. The Contracting Authority plans to perform not less than 50% of the amount of work provided for in the offer cost estimate..

1.8. The Contracting Authority reserves the possibility to change (increase or decrease) in the quantities of measurement units/times of the treatments given in the tender cost estimate where more of the specified scope of work is required during the execution of the contract (at the expense of reduction different scope of work). The changes made in this way may not exceed the remuneration of the contractor specified for this purpose in § 4 paragraph 1.

1.9. The method of execution and the detailed scope of services shall be determined by the Designed provisions of the contract together with Annex 1 to the contract - the Offer Cost.
