SWZ compliant numbering:

3.1. The object of the order is the purchase for a period of 12 months of electricity for the needs of Krakow Technological Park sp. z o.o. with a breakdown of 2 parts:

3.1.1. part no. 1 — purchase of electricity for the purposes of the building “KPT Podole” in Krakow at 60 Podole Street;

3.1.2. part no. 2 — purchase of electricity for the purposes of the building “Zyczkowskiego KPT” in Krakow at 14 Prof. Michał Życzkowskiego Street.

3.2. A detailed description and method of execution of the order shall include a description of the object of the contract, constituting Annex 2 to the SWZ and the proposed provisions of the contract constituting the Annex

No. 7 to SWZ.

1. The subject of part No. 1 of the order is the purchase of electricity for the purposes of the building “KPT Podole”

The sale of electricity is to be carried out under the conditions laid down by the provisions of the Act of 10.04.1997. Energy law (i.e., 19.04.2021, OJ 2021.716) in accordance with the applicable regulations to the law and the provisions of the Civil Code.

2. The planned electricity consumption for the duration of the contract (12 months) is 1850 MWh. The planned consumption of electricity is only indicative, used to compare tenders and in no case constitutes an obligation on the part of the Contracting Authority to purchase electricity in the quantity given. The Contractor shall not be entitled to any claim for not collecting the indicatively given amount of energy by the Ordered Contractor.

3. Electricity supply place: Current terminals of rail connector from the site of equipment Tauron Distrybucja sp. z o.o. in transformer station assigned to PPE code 590322429302771282 and 590322429302771299 located in Krakow at Podole Street 60. equipment between the electricity distribution company and the Contracting Authority constitute the current terminals of the rail connector from the site of equipment Tauron Distribution sp. z o.o.

4. The place of measurement of electricity is where current measurement translators are installed. Measurement of the electricity supplied is carried out by measuring and billing system,

whereby:

Connection 1:

(a) The 30/5A current translators are the property of the Ordering Party,

(b) Voltage translators 15000:1 ,73/ 100:1 ,733 V are the property of the Ordering Party,

c) A 1-tariff counter of active energy with a max power and reactive energy indicator is the property of the Ordering Party and is built: in a transformer station,

d) The 1-tariff active power control counter with max power indicator is the property of the Ordering Party and is built: in the transformer station.

Connection 2:

(a) The 30/5A current translators are the property of the Ordering Party,

(b) Voltage translators 15000:1 ,73/ 100:1 ,733 V are the property of the Ordering Party,

(c) 1-tariff counter of active energy with max power and reactive energy indicator, which is the property of the Contracting Authority,

d) The 1-tariff active power control counter with max power indicator, which is the property of the Ordering Party, and are built up: in the transformer station.

5. The Contracting Authority is eligible for Joining Group III. It is set for the connection: Connection power for each connection Pp = 800 kW, contractual power Pu = 620 kW and 156 kW, tg = 0.4, minimum contractual power for each connection, P umin = 156 kW.

6. Settlements for the electricity sold will be based on the monthly indications of the measurement and settlement system according to tariff group B21.

7. At the present time, the Ordering Party has concluded on 02.02.2021 the Electricity Sales Agreement with ENERGA OBRÓT S.A. with its registered office in Gdańsk at Grunwaldzka al. 472, 80-309 Gdańsk. The contract is concluded for a fixed term until 31.12.2021 at 24:00.

At the same time, the Ordering Party informs that it is bound by an agreement for the provision of electricity distribution services concluded on 04.12.2015 with Tauron Distrybucja S.A., Jasnogórska 11 Street, 31-358 Kraków.

8. The Contractor will be required to ensure the sale of electricity without interruption (the need to maintain the continuity of power supply of the equipment of the Contracting Authority).

9. The Contractor shall be obliged to carry out, on behalf of the Contracting Authority, the necessary procedures for changing the electricity seller. If necessary, the Contracting Authority shall grant the Contractor an appropriate power of attorney in this respect.

10. The agreement will be concluded on the model presented by the Contractor. It will have to take into account the proposed provisions of the contract set out in Annex 7 to the SWZ.

1. The object of part 2 of the order is the purchase of electricity for the purposes of the building “Zyczkowskiego KPT” in Krakow at 14 Prof. Michał Życzkowskiego Street in Krakow. The sale of electricity is to be carried out under the conditions laid down by the provisions of the Act of 10.04.1997. Energy Law (i.e. Journal of Laws of 2020, item 833), in accordance with the applicable regulations to the law and the provisions of the Civil Code of 23.04.1964.

2. The planned electricity consumption for the duration of the contract (12 months) is 750 MWh. Planned electricity consumption for indicative purposes only, for comparison of bids

and does not in any case constitute on the part of the Contracting Authority an obligation to purchase electricity in the quantity specified. The Contractor shall not be entitled to any claim for the failure of the Contracting Authority to collect the quantity of energy indicated by the Contractor.

3. Electricity supply place: Current terminals of rail connector from the site of equipment Tauron Distrybucja sp. z o.o. in transformer station no. 22464 located in Krakow at Prof. Michał Życzkowskiego Street 14. electricity distribution and the Ordering Party constitute the current terminals of the rail connector on the side of the equipment Tauron Distribution sp. z o.o. in the transformer station no. 22464.

4. The place of measurement of electricity is where current measurement translators are installed. Measurement of electricity supplied shall be carried out by measuring and billing system, with:

Connection:

(a) 20/5A current translators are the property of the Ordering Party,

b) 15/V3/0,1/V3 kV voltage translators are the property of the Ordering Party,

(c) 1-tariff counter of active energy with max power and reactive energy indicator, which is the property of the Contracting Authority,

d) Active Power Control Counter 1-tariff with max power indicator, which is the property of the Contracting Authority,

and are built in a transformer station.

5. The Contracting Authority is eligible for Joining Group III. Connection power for the entire object Pp = 500 kW. Estables for connection: Connection power Pp = 500 kW, contractual power Pu = 500 kW, tglo= 0.4, minimum contractual power resulting from 20% of the rated current translators at cosl = 1, P umin = 104 kW.

6. Settlements for sold electricity will be based on monthly indications of the measurement and settlement system according to tariff group B21.

7. At the present time, the Ordering Party has concluded on 02.02.2021 the Electricity Sales Agreement with ENERGA OBRÓT S.A. with its registered office in Gdańsk at Grunwaldzka al. 472, 80-309 Gdańsk. The contract is concluded for a fixed term until 31.12.2021 at 24:00.

8. In addition, the Ordering Party has concluded on 10.12.2014 an agreement for the provision of electricity distribution services no. 402008822/2014 with Tauron Distrybucja S.A., Dajwór 27 street, 30-960 Kraków. The contract for the provision of distribution services is concluded for an indefinite period.

9. The Contractor will be required to ensure the sale of electricity without interruption (the need to maintain the continuity of power supply of the equipment of the Ordering Party tenants)

10. The Contractor shall be required to carry out, on behalf of the Contracting Authority, the necessary procedures relating to the change of the electricity seller If necessary, the Contracting Authority shall grant the Contractor an appropriate power of attorney in this respect.

11. The Agreement shall be concluded on the model presented by the Contractor. It will have to take into account the proposed provisions of the contract set out in Annex 7 to the SWZ.
