1.The subject of the contract is the purchase of electricity within the meaning of the Act of 10 April 1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385, as amended) to the facilities of WPWiK Sp. z o.o. listed in Annex 1a to the SWZ and WZWiK listed in Annex 1b to the SWZ.

1. The subject of the contract is the purchase of electricity within the meaning of the Act of 10 April 1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385, as amended) to the facilities of WPWiK Sp. z o.o. specified in Appendix No. 1a to the Terms of Use and WZWiK specified in Appendix 1b to the Terms of Reference. 2. A detailed description of the contracting authority's facilities along with the determination of the estimated demand for the amount of electricity and other data necessary for the preparation of the offer are described in Appendix No. 1a and 1b to the Terms of Reference. NOTE: the facilities have a measurement system adapted to the change of seller. 3. In addition, the contractor is obliged to perform the contract on the terms and conditions described in the contract template constituting Appendix No. 4 to the Terms of Reference. 4. The figures indicated in Appendix No. 1a and 1b to the Terms of Use are estimates and do not reflect the actual or declared use of electricity and are used only to calculate the price of the offer. 5. The Contractor submitting the offer is obliged to have a valid and binding general distribution agreement with the local Distribution System Operator (hereinafter referred to as DSO), on the basis of which it may sell electricity to all facilities covered by the contract. The Contracting Authority shall grant the contractor whose bid is selected an appropriate power of attorney to represent the DSO in matters related to the submission of the sales contract. The Ordering Party will provide the necessary data to carry out the process of a possible change of seller on time. 6. The anticipated possible change of the energy supplier will be another change for both entities (WPWiK Sp. z o.o. and WZWiK). 7. Contracting Parties do not take advantage of promotional and loyalty offers. 8. Other requirements regarding the description of the subject matter of the contract are specified in the Terms of Reference. 8. Purchase offers are required.
