1. The subject of the contract is the service of booking, purchase and delivery of air and railway tickets for domestic and foreign routes, as well as reservation and purchase of hotel places, insurance and mediation in the process of obtaining visas for delegates of State Administration Units.
2. Appendix 1 to the SWZ contains a list of Units covered by the contract.
3. The detailed manner of implementation of the subject of the contract is specified in Annex 2 to the SWZ - Description of the subject of the contract and in Annex 3 to the SWZ - Draft provisions of the contract.
4. The Purchaser does not allow submission of partial offers.
5. The contracting authority does not provide for the award of contracts referred to in Article 214(1)(7) of the PPL.
6. The Contracting Authority does not provide for an electronic auction referred to in Articles 227 to 238 of the PPL.
7. The contracting authority shall not allow the submission of variant bids within the meaning of Article 92(1) of the PPL.
8. The Contracting Authority does not provide for the conclusion of a framework agreement.
1. The subject of the contract is the service of booking, purchase and delivery of air and railway tickets for domestic and foreign routes, as well as reservation and purchase of hotel places, insurance and mediation in the process of obtaining visas for delegates of State Administration Units.
2. The subject of the contract provides for the purchase of:
a) 20 782 pcs. air tickets on foreign routes,
b) 2 615 pcs. air tickets on domestic routes,
c) 817 pcs. train tickets on foreign routes,
d) 7 294 pcs. train tickets on domestic routes,
e) 18 360 pcs. hotel rooms outside the country,
f) 23 659 pcs. hotel places in the country,
g) 5 381 pcs. travel insurance policies,
h) 255 pcs. visa procedures.
3. Under the name “one ticket”, the ticket on the route must be understood: “back and forth”. The Contracting Authority reserves the option to purchase “one way” tickets.
4. The name 'one hotel place' shall be understood the hotel day with breakfast or without breakfast at the request of the Ordering Party, with a parking space provided in the country.
5. The contracting authority does not provide for reimbursement of the costs of participation in the procedure, including reimbursement of costs incurred for the acquisition of a qualified electronic signature.
6. The Contracting Authority shall not allow tenders in the form of electronic catalogues to be submitted or electronic catalogues to be attached to the tender.
7. The Contractor joining the proceedings is obliged to pay a deposit in the amount of: PLN 200,000.00 (in words: two hundred thousand zlotys 00/100). Detailed conditions for lodging a bid bond are set out in Chapter VII of the SWZ.
8. The Contracting Authority may cancel the procurement procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it.
9. Pursuant to Article 95(1) of the PPL, the Contracting Authority requires that throughout the term of the contract, persons performing the activities of booking and delivering air and rail tickets together with insurance for foreign and domestic passenger transport, booking and purchasing hotel places and mediating in the process of obtaining visas for delegates for the needs of the Contracting Authority be employed under an employment contract, in accordance with Article 22 § 1 of the Act of 26 June 1974 - Labour Code (i.e. Journal of Laws of 2019, item 1040, as amended).
10. The Ordering Party shall consider fulfilled the obligation to employ persons performing services in the field of booking and delivery of air and railway tickets together with insurance for foreign and domestic passenger transport, reservation and purchase of hotel places and mediation in the process of obtaining visas for delegates for the needs of the Ordering Party in the performance of the contract under an employment contract in the case of: when the Contractor directs its own employees with a total working time corresponding to a minimum of two full-time jobs to perform the contract. The Contracting Authority shall not interfere in the manner of conducting business and the organization of work in the scope of maintaining the Contractor's activities.
11. In the event of justified doubts as to the fulfilment of the requirement specified in paragraph 9, the Contracting Authority reserves the right to verify the manner of employment of persons referred to in paragraph 9 by:
1) request the submission of anonymised employment contracts of these persons (except for their first and last names), and/or:
2) submitting an application to the National Labour Inspectorate for an inspection of the manner of employment of the above-mentioned employees.
12. Pursuant to Article 96(2)(2)(d) of the PPL, the Contracting Authority requires the Contractor to carry out an apprenticeship for juveniles in the scope of the subject of the contract. The internship should take place at the Contractor's headquarters in the dimension of min. 160 hours for one juvenile. An exemplary thematic scope of internships is included in Annex 10 to the SWZ.
