1. The subject of the contract is the supply of electricity in the period from 01.01.2024. until 31.12.2024 - up to 316 points of consumption (PPE) with a total estimated volume (+/- 10%) of 9,920.95 MWh, of which:
1) For premises and facilities (Part 1 of the contract) – 5,576.36 MWh – a detailed list of PPE is attached as Appendix 1a to the Terms of Reference.
2) For the purposes of road lighting (Part 2 of the contract) – 4,344.59 MWh – a detailed list of PPE is attached as Appendix 1b of the Terms of Reference.
2. The forecasted electricity consumption indicated above is indicative and may differ from the amount of energy actually consumed during the term of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the ordering party (customers), except for the need to pay for the amount of energy actually consumed.
3. The contracting authority shall not allow variants to be submitted.
4. Procurement mode: unlimited tender — pursuant to Article 132 of the Pzp Act.
Supply of electricity to premises and facilities1. Number of metering systems accounting for consumed electricity 151 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract - 5,576.36 MWh. Consumption data are indicative.
4. Deliveries will take place from 01.01.2024. until 31.12.2024, subject to the delivery deadline for item 111 - details of delivery dates in relation to individual collection points are described in Appendix No. 1a to the Terms of Reference, column "Delivery period".
5. The electricity supply / comprehensive electricity supply contracts currently in force will expire or terminate with effect from the day preceding the planned start date of the supply (column "Delivery period"). The obligation to terminate contracts lies with the contracting authorities (recipients).
6. The metering system with tariff group B is adapted to the procedure of changing the seller.
7. As a result of the outcome of the proceedings for Lot 1, one contract will be concluded
8. Quality Standards:
1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.
2) Electricity quality standards are described in the EP Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819). The rules for shaping and calculating tariffs and settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 (Journal of Laws of 2022, item 2505 with późń.zm.).

10. The proceeding did not cover PPE with the status of a Prosumer.
11. The Contractor, based on the Power of Attorney granted, will be obliged to submit the contract on its own behalf and the contracting authority to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.
12. The Contracting Authority requires the payment of a tender deposit in the amount of: PLN 50,000.00.
13. The contracting authority reserves the right to make use of Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer has been rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
