The type, description and terms of delivery are specified in Appendix No. 2.1 (Price Form) and in Appendix No. 4 (Model Contract) to the SWZ. The parts offered must strictly comply with the requirements set out in Annex 2.1 to the SWZ; be brand new, free from defects, meet the relevant quality requirements and the requirements of European standards or Polish Standards transposing European standards, as well as not burdened with the rights of third parties; be manufactured not earlier than 12 (twelve) months before the order completion date.

1. The Ordering Party allows the possibility of submitting an offer for a product with a different catalog number or designation than indicated in the Price Form, whose nature. has been defined. in § 1 section 7 of the Model Agreement (hereinafter referred to as "Replacement Product"). 2. Document obligations. resulting from the offer by the contractor of the replacement Product specify. have been included in §1 sections 8-10 of the Model contract and are implemented in the course of the contract. 3. In all records of the contract notice, SWZ and its annexes, in which Zamaw. describes before. procurement by indication of trade marks, patents or origin, source or particular. a process that character. products or services provided by Konkretn. contractor, it should be considered that Zamaw. shall authorise an equivalent product accompanied by the words 'or equivalent' (hereinafter 'Equivalent product'). 4. If the contractor offers equivalent Products, i.e. the contractor indicates this circumstance in the submitted offer, the contractor is obliged to demonstrate that the equivalent Products offered by him meet the requirements specified by the Order. In such a situation, the contractor will oblige. is to submit together with the offer next. documents: (a) a report (documentation) drawn up in accordance with the Regulation. No. 402/2013 Annex 1 point 5.2 on the assessment of the significance of the change (assessment of the potential impact of the change on safety) and a report (documentation) on the risk management process from the introduced change consisting in applications. equivalent spare parts, drawn up in accordance with Article 2(1) of the Regulation. Commission Implementing Regulation (EU) No 402/2013 of 30 April 2013 on a common safety method for risk evaluation and assessment and repealing the Regulation. (EC) No 352/2009 (OJ L. of 2013, No 121, p. 8, as amended), (b) where the contractor decides that the entity responsible for introducing the change in the type of capacity. railway for which the equivalent spare part is intended is intended by the holder of the authorisation, the contractor shall provide: a declaration of conformity to type in respect of introductions. changes in rail vehicles involving the use of a spare equivalent part. or equivalent standards, issued by the holder of the authorisation for the vehicle type referred to in Commission Implementing Regulation (EU) 2018/545 of 4 April 2018. compatible. practical for the purposes of the authorisation process for POJ. railway and authorisations for a type of railway vehicle in accordance with the Directive of the European Parliament. and of the Council (EU) 2016/797 (OJ L. of 2018, No 90, p. 66, as amended). The declaration of conformity referred to in the previous sentence shall be provided separately for each of the types of water. rail for which an equivalent spare part is intended. or (c) Where the contractor transfers responsibility for introducing the change in the water. railway for which the equivalent spare part is intended for Zamaw., the contractor is obliged to provide: EC certificate of verification for the subsystem with use. an equivalent spare part, including a document. techn. of the commodity subsystem. EC verification, issued by a notified body authorised in accordance with the Directive of the European Parliament. and of the Council (EU) 2016/797 of 11 May 2016 on the interoperability of the rail system within the EU (OJ L. of 2016, No 138, p. 44, as amended). With a reservation that Zamaw. does not allow the supply of equivalent spare parts if, as a result of their use in the configuration of the rail vehicles for which they are intended, the criteria of Article 15, paragraph 1, letter c) or (d) of the Regulation are met.
