1. The subject of the contract is the supply of electricity to the Ordering Party's facilities in the period from 01.01.2023 to 31.12.2023 divided into two parts:
1.1. Part I concerns energy consumption points (also called PPE) for street lighting, the maximum order volume during the term of the contract is: 4 860 330 kWh – according to Annex 1A to the SWZ.
1.2. part II concerns PPE for other facilities, the maximum order volume during the term of the contract is: 14 504 892 kWh – according to Annex 1B to the SWZ.
Electricity supply - street lighting1. The subject of the contract is the supply of electricity to the Ordering Party's facilities in the period from 01.01.2023 to 31.12.2023. for part I concerns energy consumption points (also called PPE) for street lighting, the maximum order size during the contract is: 4 860 330 kWh – according to Annex 1A to SWZ.
2. Each Contractor may submit a bid for any quantity of parts of the order, with only one offer available for one part.
3. The detailed scope of the contract is specified in Annex 1A to the SWZ, in accordance with the provisions of the Energy Law Act of 10 April 1997. Other conditions regarding the execution of the contract are specified in the draft provisions of the electricity sales contract – Appendix No. 2A to the SWZ (applies to the first part of the contract).
4. The supply of electricity will take place under the conditions set out in the provisions of the Act of 10 April 1997 – Energy Law and in accordance with the implementing provisions issued to this Act, in particular with the standards of quality of customer service specified in the Regulation of the Minister of Energy of 6 March 2019. on detailed rules for the formation and calculation of tariffs and settlements in electricity trading. The quality parameters of electricity in the distribution part are regulated by the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system.
5. Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the relevant Distribution System Operator (called DSO) – DSO data are included in Appendix No. 1A to SWZ. The reserve seller is: Enea S.A., Energa Obrót S.A., PGE Obrót S.A.
6. The requirements (obligations) imposed on the contractor are described in the draft provisions of the sales contract constituting Appendix No. 2A to the SWZ. Performance of activities resulting from the power of attorney constituting Appendix No. 2 to the Agreement for the Sale of Electricity, hereinafter referred to as the Agreement. The contracting authority shall grant the contractor selected in the proceedings a power of attorney.
7. Existing contracts for the sale of electricity with existing electricity sellers for electricity consumption points included in Annex 1A of the SWZ are concluded for a definite period, and the exact description for each of the PPE points can be found in the column called "Duration of the contract / notice period".
8. Annex 1A of the SWZ informatively indicates the current parameters (tariff group/contractual capacity) that may be subject to change during the term of the contract for the sale of electricity.
9. The amount of electricity indicated in paragraph 1 shall be the maximum quantity. Within the maximum size, the Ordering Party reserves the right to change, on the terms and to the extent specified in the SWZ.
The occurrence of the circumstances referred to above will result in a reduction or increase in the remuneration due to the contractor for the performance of the contract, respectively. The reduction of the amount of electricity, including the subtraction of the PPE, shall not give rise to any claims on the part of the contractor.
10. The Ordering Party has the right, during the term of the contract, to change the tariff groups, the contractual capacity for individual PPEs specified in Annex 1 to the contract (Annex 1A to the SWZ) after prior agreement on the technical conditions for making these changes with the Distribution System Operator, hereinafter referred to as the DSO. Changes in the contract will take place on a written notification of the contracting authority to the contractor starting from the change by the DSO. The above changes will be carried out on the terms set out in the tariff of the distribution system operator appropriate for the ordering party and will concern, in particular, ensuring proper functioning of the facility (in accordance with its intended purpose) or reducing costs on the distribution service.
Electricity supply - other facilities1.
