1. The subject of the contract is the performance of repairs in the P5 maintenance level of ten Electric Multiple Units of the Flirt Polska ER75 series along with modernization and additional works.

2. In all provisions of the SWZ and its annexes, in which the Ordering Party refers to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the PPL Act, it allows the use of equivalent solutions, standards, technical assessments, technical specifications and technical reference systems, indicated in the SWZ and annexes. In the case of using equivalent solutions, the Contractor is obliged to demonstrate in writing the equivalence of the technical parameters offered in relation to the subject of the contract.

3.The detailed description, scope and manner of execution of the subject of the contract shall be defined by the Designed provisions of the contract, annex 11 to the SWZ and the annexes to the Designed provisions of the contract.

4. The Ordering Party requires that the Contractor and the subcontractor perform the order with employees employed under an employment contract in the scope of activities indicated in § 2 of the Proposed provisions of the contract constituting Annex 11 to the SWZ, i.e.

1) preparation of the vehicle for repair consisting in dismantling and assembling complete trolleys: rolling, driven with transmission and braking system,

2) assembly, stationary and movement tests after repair and final acceptance of the complete vehicle,

3) performing measurements of castors, inspections of SHP, CA and SEP E and D, UT2, PT2, MT2 tests.

The method of documenting the employment of employees, the Ordering Party's rights to control the Contractor's compliance with the requirements and sanctions for non-compliance with specific requirements are included in the Draft Provisions of the Agreement constituting Annex 11 to the SWZ.

5.The Ordering Party requires the subject of the contract to be provided by the Contractor with the implemented quality management system based on IRIS standard (ISO/TS) 22163). The subject of the contract should be carried out with the standards in terms of quality, reliability

and technical security, according to such a standard.

6. In the event of the need to perform welding works, the Ordering Party requires that before performing them, the Contractor presents a certificate and a list of qualified personnel enabling welding in accordance with the PN-EN 15085:2 standard.

7. The Ordering Party requires a quality guarantee for a period of at least 18 months, counting from the date of signing the commission acceptance protocol of a given electric multiple unit, for works performed under the subject of the contract / for the entire vehicle after repair, depending on the Choice of the Contractor.

8. The Ordering Party requires the completion of the order by 31 December 2024.

9. The Ordering Party requires the P5 maintenance level of repair of each electric multiple unit together with additional works and modernization within no more than 80 calendar days, counting from the date of handing over the electric multiple unit for repair.

10. The Contracting Authority does not request the tender of the means of evidence in question.
