Execution time:
Start of execution: no later than 12 working days after receipt of the order letter
End of execution: within 303 working days after the start of execution
Security for the fulfilment of the contract is to be provided in the amount of 5% of the order total (including sales tax, without supplements), provided that the order total is at least 250,000 euros excluding sales tax.
The security to be provided for claims for defects amounts to 3 percent of the settlement amount (including value added tax) including supplements issued. Time of return for an unused security for claims for defects (§ 17 para. 8 no. 2 VOB/B): 4 years
Contractual penalties (§ 11 VOB / B)
If the specified individual deadlines or the deadline for completion are exceeded, the contractor must pay as a penalty for each working day of the delay: 0.2 percent of the order total mentioned in the order letter without VAT; amounts for maintenance services offered are not taken into account. The benchmark for calculating the contractual penalty when individual deadlines agreed as the contract period are exceeded is the part of this order sum that corresponds to the services to be provided contractually up to that point. The penalty is limited to a total of 5% of the order amount stated in the order letter (excluding VAT).
