a) Part No. 5: Works related to the winter maintenance of county roads and bridges in the Zawoja Commune in the winter season 2022/2023 The Contracting Authority requires that the Contractor has at its disposal for each task fully operational equipment required in the Detailed Technical Specification (hereinafter: SST) to perform the subject of the contract. The Contractor may not submit the equipment required by the Ordering Party for the performance of the service, submitted to one task, to another task for which it submits an offer. The presentation in the list of equipment of the minimum amount of equipment to confirm the condition of participation in the procedure does not release the Contractor from the obligation to provide such a quantity of equipment that will ensure the proper performance of the contract regardless of the weather conditions prevailing at the moment As part of the Winter Road Maintenance service, the Contractor is obliged to perform telephone duty, as well as to patrol the places covered by the contract and to perform on-call time with equipment (monitoring and readiness to perform services). The Contractor will be obliged to remain ready to perform the winter road maintenance service throughout the period of the Winter Action. Other information in SWZ. Conditions for participation: The Contracting Authority shall consider the above-mentioned condition to be fulfilled if the contractor has or will have at its disposal at least the following, fully operational own equipment or had access to such equipment without time limits during the performance of the contract in individual tasks (for each task separately): a) For part No. 5: Municipality of Zawoja, a minimum amount of equipment is required: - ploughing machine – pcs. 2 (it is allowed to separate the plow and separately the sandblaster) - loader - pcs. 1 - rotor plough – pcs. 1 (it is possible to use solar panels) 5.4 The means of proof required of the contractor include: 5.4.1. Statement of the contractor, within the scope of Art. 108 sec. 1 point 5 of the Public Procurement Law, on the lack of belonging to the same capital group, within the meaning of the Act of 16.02.2007 on competition and consumer protection (Journal of Laws of 2019, item 369), with another contractor who submitted a separate offer, partial offer or application for admission to participate in the procedure, or statements on belonging to the same capital group together with documents or information confirming the preparation of the offer, a partial offer or an application to participate in the procedure independently of another contractor belonging to the same capital group (according to the template presented by the Contracting Authority at a later stage of the procedure); 5.4.2. A list of tools, plant equipment and technical devices necessary to perform the contract, available to the contractor for the performance of the contract (confirming the condition specified in point 4.1.2 point 4 of the SWZ) together with information on the basis for disposing of these tools and technical devices (according to the template presented by the Ordering Party at a later stage of the procedure). 5.4.3. The contractor's statement on the validity of the information contained in the statement referred to in Article 125(1) of the Public Procurement Law to the extent related to the grounds for exclusion indicated in Article 108(1)(3-6) of the Public Procurement Law; (according to the template presented by the Ordering Party at a later stage of the proceedings). 5.4.4. Information from the National Criminal Register in the scope of exclusion grounds indicated in Article 108(1)(1),(2) and (4) of the Public Procurement Law prepared not earlier than 6 months before its submission.
