Comprehensive supply of electricity in 2024 for the needs of the purchasing group of the Municipality of Sokołów Małopolski in the amount of 3698 MWh.

1) The subject of the contract is a comprehensive supply of electricity in 2024, including the sale of electricity and the provision of electricity distribution services for the needs of the purchasing group of the Municipality of Sokołów Małopolski.

2) The estimated electricity consumption during the term of the contract is

3698 MWh.

3) The place of supply of electricity are the points of consumption of the purchasing group. listed in Annex 1 to the SWZ.

4) The sale of electricity will take place. under the conditions set out in the provisions of the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385) by implementing regulations to this Act, in particular the Regulation of the Minister of Economy of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 632), the Regulation of the Minister of Climate and Environment of 29 November 2022 on detailed rules

shaping and calculating tariffs and settlements in electricity trading (Journal of Laws, item

2505 and of 2023, item 226) with the rules set out in concessions,

provisions of the SWZ and the price of electricity presented in the offer, and

with prices of distribution parameters in accordance with the current tariffs of the network operator

distribution, approved by the President of the Energy Regulatory Office with whom

The Contractor has concluded a contract for the provision of distribution services.

(5) Due to the nature of the contract, it is not possible to determine the exact consumption of the electricity covered by the subject-matter of the contract. The Contracting Authority presented an estimated amount of electricity consumption and anticipates that the actual amount of electricity consumption may change, i.e. increase or decrease while maintaining the offered unit prices given in the Contractor's offer. Thus, the indicated estimated electricity consumption does not constitute an obligation for the Ordering Party to purchase electricity in the given amount.

6) Settlements for the distribution of electricity will take place on the basis of current indications of metering and settlement systems according to the rates of fees resulting from the submitted offer and the Distribution System Operator's Tariff, the Seller's Tariff.

7) When submitting a bid, the Contractor must have concluded a contract for the provision of electricity distribution services with the distribution system operator operating on the premises of the Contracting entity or a statement that it has an agreement with the Distribution System Operator enabling the provision of electricity distribution services to the Ordering Party's facilities or a statement on ensuring the conclusion of such an agreement.

8) The quality standards referred to in Art. 246(2) of the Public Procurement Law are specified in the Energy Law and executive acts and Polish standards.

9) The Contracting Authority shall grant the Contractor a power of attorney to terminate the existing contracts for the sale and distribution of electricity within the framework of applicable regulations and to the extent mutually agreed by the Contracting entity and the Contractor.
