The scope of the contract includes:

1. supply of electricity (hereinafter referred to as' EE ') to customers from the Opole and Silesian Voivodeship, who on 20.02-16.04.2021 authorised the Municipality of Kędzierzyn-Koźle to jointly carry out the procedure and award the public contract for the supply of electricity in the year 2022 to facilities managed by public finance units from Opole and Silesian Voivodeship. The order includes the need for EE for objects administered by:

— municipal offices and municipal organizational units,

— district and district organizational units,

— cultural institutions,

— local government legal entities,

— other units of the public finance sector.

The scope of the contract includes:

1. supply of electricity (hereinafter referred to as' EE ') to customers from the Opole and Silesian Voivodeship, who on 20.02-16.04.2021 authorised the Municipality of Kędzierzyn-Koźle to jointly carry out the procedure and award the public contract for the supply of electricity in the year 2022 to facilities managed by public finance units from Opole and Silesian Voivodeship. The order includes the need for EE for objects administered by:

— other units of the public finance sector.

The Contracting Authority provides for the possibility of exercising the right of option referred to in Article 441 (1) of the Pzp Act covering the possibility of increasing the supply of electricity under the terms of the contract by a further 30% of the basic contract when, after the settlement of the tendering procedure, the will be new energy consumption points or in case of increased demand for electricity supply to PPE listed in Annex 5 to SWZ- Electricity demand _Summary of electricity customers and description of electricity consumption points

The right of option is the power of the Contracting Authority, which it may, but does not have to exercise in the implementation of this Agreement. In the event that the Contractor does not exercise the right of the option, the Contractors shall not be entitled to any claim in this respect. The condition for the activation of the option right is to submit a statement of will by the Contracting Authority to exercise the right of option to the extent specified by it.

2. The order included 2292 EE intake points feeding buildings, premises, utility facilities, street lighting, street traffic lights and water and heating systems.

These facilities, their administrators and EE collection points shall describe in detail Annex 5 to SWZ- Electricity demand _Summary of electricity customers and description of electricity consumption points, as set out in electronic version on the website the proceedings being an integral part of the SWZ.

3. Annual electricity demand was set at 46,769,248,00 kWh (with the right option approx. 60,800 022.40 kwh). This is a indicative value, see paragraph 7.

4. The breakdown by tariff types includes Annex 6 to SWZ - Balance of EE demand according to tariffs.

5. Before the conclusion of the specific contract or during the period of its application, the Contracting Authority reserves the right to choose a tariff different from the current EE collection point (shown in Annex 5 to SWZ), provided that the requirements of the Distribution System Operator are met ( OSD).

6. Under the General Agreement concluded by the Contracting Authority with the selected Contractor (EE supplier), specific contracts will be concluded by the individual administrators of the facilities where the individual EE conscription points are located.

7. The determination of the anticipated consumption of electricity is an element serving only to determine the value of the contract and does not constitute the obligation of the Ordering Party to purchase electricity in the quantities given.

8. Each consignee specified in Annex No 7 to SWZ, the list of contracting units shall independently enter into an individual contract for the distribution of electricity.
