Description:

Supply of aerodrome power supply equipment for military aircraft LUZES V/D series V or equivalent with training in their operation

1. The subject of the contract is the supply of brand new, derived from the production of 2022/2023 airport power supply equipment for military aircraft LUZES V / D series V or equivalent, hereinafter referred to as "products" in the assortment and quantities specified in the Price Form constituting Annex 1 to the SWZ along with training of persons in their use, operation and basic performance, uncomplicated repairs. Products constituting the subject of the order should be manufactured in accordance with

with current technical documentation of their production and meet the technical requirements set out in Annex 2 to the Draft provisions of the contract. In addition, the Contractor shall provide the Technical Documentation referred to in § 9 of the Draft provisions of the contract.

2. The Contractor shall, at its own expense, conduct theoretical and practical training of persons designated by the Recipients in the amount of up to 5 people for each copy of the product

in the field of operation and service. The training will be carried out on the basis of the training program developed by the Contractor, agreed by him with the Head of Aviation Technology of the Armed Forces Support Inspectorate (STL IWsp SZ),

Dwernickiego 1, 85-915 Bydgoszcz no later than one week before the first transfer of the devices to the Recipient. The condition for accepting the product is to conduct training ending with the issuance of individual certificates entitling

to operate the product.

3. The Contractor shall provide a guarantee for the subject of the contract in the amount of not less than 24 months, counting from the date of signing the acceptance-transfer protocol by the representatives of the Contractor and representatives of the Recipient, and any additional warranty period granted by the Contractor will be beneficial to the Contracting Entity.

4. The customer requires at least 1 service point in the Polish.

5. The Contractor's quality management system should meet the requirements of

in PN:EN ISO 9001:2015.

6. The subject of the contract will be subject to military acceptance by the Regional Military Representation (RPW) on the terms set out in this SWZ.

7. At the same time, the Contractor together with the products shall provide the OiB declaration of conformity issued in accordance with the Act of 17 November 2006 on the conformity assessment system of products intended for the needs of defense and state security (Journal of Laws

of 2022, item 747, as amended) and indicated in the Regulation of the Minister of National Defense

of 11 January 2013 on the detailed list of products subject to conformity assessment and the method and procedure for conducting conformity assessment of products intended for the needs of state defense (Journal of Laws of 2021, item 1628, as amended) -

i.e. in mode I conformity assessment.

8. Products should meet the quality requirements specified in the manufacturer's technical documentation for the product.

9. The requirements of AQAP 2110 ed. D version 1

10. The condition for meeting the requirements of equivalence of products is to meet the operational and technical requirements set out in Annex 2 to the Draft provisions of the agreement.

11. When offering equivalent products, the Contractor is obliged to indicate in box 5 of the Price Form constituting Annex 1 to the SWZ in the scope of equivalent products offered, their names, types/models and manufacturer.

12. The contracting authority requests that the offer be accompanied by the evidence referred to in Chapter IV of the SWZ, confirming that the proposed equivalent solution meets the requirement set out in point 11.

13. In the case of equivalent products, the Contractor is obliged to provide

to each Recipient and Contracting Authority the Technical Documentation referred to in § 9 of the Draft provisions of the contract, in the following scope:

a) security measures – agreed with STL IWsp SZ:

Manual Technical Manual (IOT);

b) production – agreed with RPW:

Technical Conditions (WT);

c) use – agreed with STL IWsp SZ, which includes:

Instructions for Use (IU);

Book Devices (KU).

14. The Ordering Party reserves the right of option. Under the right of option, the Ordering Party may additionally order the delivery of products in the assortment and

up to the maximum quantities specified in Annex 1 to the Draft provisions of the contract constituting Annex 2 to the SWZ.

The optional order will be fulfilled at the same unit prices as in the basic order, in accordance with the offer submitted by the Contractor.

The Ordering Party shall inform the Contractor in writing about the intention to exercise the option right and its quantity by 29 September 2023 at the latest.

The contracting authority reserves that it will be able to order the delivery of a part of the contract under the option right in the event of obtaining funds for this purpose and when the interest of the Polish Armed Forces so requires. The delivery order for a part of the order under the option right is a right and not an obligation of the Ordering Party.

15. Detailed conditions for the performance of the contract are set out in the Draft provisions of the contract constituting Annex 2 to the SWZ.

16. Pursuant to Article 455 of the PPL, the contracting authority allows for the possibility of amending the contract

without conducting a new procurement procedure in the cases of

and under the conditions specified in § 20 of the Draft Agreement Provisions constituting Annex 2 to SWZ.

17. The award of the contract does not involve making classified information available to the Contractor.
