The subject of the order is the purchase of active electricity, for a period of 12 months calculated taking into account the effective change of seller procedure (from 7.6.2020 to 7.6.2021), with standard quality parameters specified in the Act of 10 April 1997 Energy Law (i.e. of April 4, 2019, Journal of Laws of 2019, item 755, as amended) and in the Regulation of the Minister of Economy of May 4, 2007 on detailed conditions for the operation of the power system (Journal of Laws 2007 No. 93 item 623, as amended). The rules for shaping and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Energy of March 6, 2019 (Journal of Laws of 2019, item 503).

1. Electricity collection points of the Awarding Entities are listed in Annex 1 to the ToR - a detailed description of the subject of the contract.

2. A detailed list of electricity consumption points together with tariff groups, the estimated planned consumption of active electricity, is set out in Annex 1 to the ToR.

3. The total number of electricity consumption points as at the day of announcement of the tender procedure is 309, including cubature structures and street, road and other lighting.

4. Due to the fact that PPEs in the Milicz commune are subject to the migration process (some are arriving, others are departing). The Employer, during the term of the provisions of the concluded contract, reserves the right to add new / not notified at the stage of concluding the PPE contract.

5. The total estimated amount of active electricity during the contract period (12 months) is: 4 184.14 MWh.

6. The estimated amount of electricity is only an estimated value, which may change during the term of the contract. The actual consumption of active electricity will depend only on actual needs. Regardless of the amount of consumption, the Contractor is always obliged to use the unit prices offered in the tender specified in the bid form, constituting Annex 2 to the ToR.

7. In the scope referred to in point 7 above, the Employer reserves the right to option at the level of +/- 20% of the estimated amount of active electricity. The contracting authority provides that pursuant to art. 34 section 5 of the Public Procurement Law, will exercise the right of option when buying electricity in the event of the need to purchase more electricity, caused by increased consumption of electricity at existing collection points, specified in Annex 1 to the ToR, covered by the subject of the contract or increasing the number of collection points and in if you need to purchase more electricity due to increased electricity consumption. The option right is the entitlement of the Employer, which he may or may not use as part of the contract. Orders under the option right will be processed within the deadline for completing the order, after using the forecast electricity consumption.

8. The Contractor may not assert any financial claims from the Employer if, during the contract period, the Employer purchases from the Contractor a different quantity of active electricity than the estimated one indicated in Annex 1 to the ToR.
