1. The subject of the order is the delivery of brand new (i.e. manufactured not earlier than 12 months before the date of delivery) active LAN devices meeting the functional assumptions of the Ordering Party together with the network management software and their implementation based on the network infrastructure located at the Ordering Party's headquarters in the building of the Palace of Culture and Science in Warsaw. The subject of the contract is also to conduct training of the Ordering Party's administrators.

2. A detailed description of the subject of the contract is contained in Appendix No. 1 to the SWZ, together with Annexes No. 1-7 to the OPZ and the proposed provisions of the contract constituting Annex No. 7 to the SWZ.

3. The place of delivery of the subject of the order is the seat of the Ordering Party.

4. Equivalent solutions. Wherever the subject of the contract is described by indicating trademarks, the Ordering Party allows the Contractor to use solutions equivalent to those described, provided that they have at least the same or better technical and functional parameters – indicated in Appendix No. 1 to SWZ and Annexes No. 1-7 to OPZ and do not lower the standards specified in SWZ. In the event that the Contractor proposes equivalent products, he is obliged to demonstrate and attach to the offer a summary of all proposed equivalent elements and demonstrate their equivalence in relation to the elements described in the SWZ. All equivalent products proposed by the Contractor must have technical and functional parameters not inferior to those indicated in Appendix No. 1 to SWZ and Annexes No. 1-7 to opz and have appropriate approvals and approvals as for the subject of the contract.

5. The Contracting Authority does not reserve the obligation for the Contractor or individual Contractors jointly applying for the award of a public contract to perform key tasks personally.
