The subject of the contract is the performance by the Contractor for the contracting authority of the service of expanding the functionality of the existing software of the Electronic Register of Cases, in the scope of providing the possibility of verifying the file resource in terms of their categorization, and thus the preparation of a database of files in current use by the Department of Foreigners' Affairs. The above is aimed at shortening the time of searching for historical files of foreigners and improving the process of document management and digitization of the register of documentation of third-country nationals located in the handy depot. Performing the service of archiving residence files of foreigners produced in tut. The Faculty will rely on the comprehensive preparation of files for the Company Archive of the Małopolska Voivodship Office in Krakow, which are archival materials (category A).

The expansion of the functionality of the existing software of the Electronic Register of Cases dedicated to third-country nationals will allow to accelerate the flow of information, which will translate into streamlining the process related to the legalization of the stay of foreigners on the territory of the Republic of Poland. Due to the significant increase in the number of submitted applications, the implementation of such a solution would make it possible to optimize the time frame in many areas related to the legalization of foreigners' stay, and thus, the given functionality would be multifaceted.

The value of the contract exceeds the EU thresholds, i.e. the amount of the contract value specified in the regulations issued on the basis of Article 3 of the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2021, item 1129, as amended), hereinafter referred to as the Act.
The contract concerns the project of the Małopolska Voivode co-financed by the European Union under the Asylum, Migration and Integration Fund, project No. 15/10-2019/OG-FAMI) entitled "I3 – INFRASTRUCTURE, INNOVATIONS, INFORMATION. Project of the Małopolska Voivode dedicated to third-country nationals."
The subject of the contract has not been divided into parts. The contract, covered by the project referred to above, has been divided and is awarded in 2 parts (two procedures conducted under the open tender procedure).
The contract is homogeneous and indivisible. It consists in archiving documentation covered by the archival category "A", which cannot be divided into smaller parts. The specialist feature of the contract, which consists in the expansion of the existing software of the Electronic Register of Cases by introducing archival matters into the ERS, testifies to its direct homogeneity and connection. The order being processed cannot be divided into parts due to the fact that all its elements are directly related. The whole subject of the contract requires implementation as one part, because there is a risk of mistakes and errors. The nature of the contract focuses on the introduction of archival matters into the existing ERS software. A possible division of the contract into lots carries a high risk of not being able to coordinate the activities of different contractors.
