The subject of the contract is the successive export of sewage sludge from the sewage treatment plant in Otwock, Kraszewskiego 1, 05-400 Otwock. The Contractor will be obliged to manage sewage sludge, which is understood as loading on its own vehicle means of transport directly from under the conveyor belt, transport to recovery or processing sites and recovering or processing in compliance with the requirements of the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699).
1. The sludge covered by the contract comes from the biological wastewater treatment process in the Otwock sewage treatment plant. These sediments are stabilized
in the process of methane fermentation, and then mechanically dehydrated.
1.1. Waste code (stabilised municipal sewage sludge) - 19 08 05,
1.2. Amount of sewage sludge to be exported successively – 25-30 Mg/d
(approx. 7500 Mg/year),
1.3. Dry matter content in the sediment - 20 - 25%,
1.4. Sludge generated in the sewage treatment plant in Otwock is tested with the frequency of consent in accordance with the Regulation of the Minister of the Environment of 6 February 2015 on municipal sewage sludge (Journal of Laws of 2015, item 257). The contracting authority has reports on sewage sludge tests,
1.5. The Ordering Party reserves the right not to use the entire order and the Contractor shall not make any claims against the Ordering Party in this respect,
1.6. The Ordering Party provides for the possibility of a supplementary order up to 50% of the value of the subject of the contract due to the impossibility of predicting weather conditions, as well as for reasons beyond the control of the Ordering Party (e.g. failure).
2. Each tenderer shall provide a detailed description of the method of recovery or treatment, including data for the assessment of compliance with the applicable legislation.
3. The contractor must present a licence for the recovery or treatment of sewage sludge.
The permit must necessarily contain the following elements:
- the type and quantity of waste destined for recovery or treatment over a period of one year,
- the place and method of storage of waste,
- conditions for loading and transport of waste,
- the duration of the authorisation.
4. The Contractor is obliged to present a current amended decision regarding waste treatment or confirm the submission of an application for a change of the decision in accordance with the amendment of Article 14 of the Act of 20.07.2018 amending the Act on Waste and certain other acts. The Contracting Authority obliges the Contractor to inform the Contracting Authority about obtaining a negative decision. In this case, the Ordering Party is entitled to withdraw from the contract between the parties.
5. In the case of sludge to a composting plant, the Contractor shall present a contract
with the composting plant to receive waste with a certain amount of waste to be composted or provides a declaration that it owns the composting plant. An integral part of the contract is the composting plant's decision to recover using the R3 method.
6. In the case of disposal of sludge for reclamation to a landfill, the Contractor shall present a contract signed with the operator of the landfill
for the use of sludge for the reclamation of the above-mentioned landfill with the determination of the amount of sludge. An integral part of the contract is the decision on reclamation.
7. The contractor is obliged to provide a statement on the planned method of recovery or treatment of the sludge in question, in accordance with its decision for the recovery or treatment of waste (the submitted declaration must be consistent with the presented decision).
8. In accordance with Article 27 point 3 of the Waste Act, the Contractor assumes full responsibility for the management of the sludge in question. Responsibility
This starts from the moment the sludge is loaded onto the means of transport at the sludge collection site at the treatment plant.
9. The Contractor is obliged to have an entry in the Product Database
and packaging and waste management (BDO).
10. The contractor shall have a permit for the transport of waste
including stabilised municipal sewage sludge by the entry
to the Database on products and packaging and on waste management (BDO).
11. The Contractor is obliged to ensure tight, protected against falling out
and adverse weather conditions, transport of sewage sludge.
12. The contractor, during the successive disposal of current sewage sludge, will substitute its own means of transport such as bathtubs (...)
