1. The subject of the proceedings is: "Comprehensive electricity supply and provision of electricity distribution services for the needs of organizational units of the Ostrowski Poviat in 2020".
2. The Contractor is obliged to carry out the subject of the contract on the terms including the Material Provisions of the Agreement, which constitute Annex 7 to the ToR.
1. Comprehensive electricity supply and provision of electricity distribution services will take place in accordance with applicable law, in particular under the conditions set out in the Energy Law of 10 April 1997 (i.e., Journal of Laws of 2019, item 755, as amended), executive regulations to this Act, in particular the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623, as amended) and the Ordinance of the Minister of Energy of March 6, 2019 on detailed rules for the setting and calculation of tariffs and settlements in electricity trading (Journal of Laws of 2019, item 503), Tariff for electricity distribution services (DSO tariff) and Distribution Network Operation and Maintenance Manual (IRiESD) of the relevant Distribution System Operator, i.e. Energa Operator SA, ul. Polish Navy 130, 80-557 Gdańsk.
2. The subject of the contract includes the supply of electricity and the provision of electricity distribution services in the planned amount of 2,123,650 kWh from 01/01/2020 to 31/12/2020 (12 months) to the electricity consumption points in accordance with Annex No. 1 to the ToR.
4. A detailed description of the subject of the contract together with the list of electricity consumption points is included in Annex 1 to the ToR. Declared in the abovementioned Annex, the electricity consumption is an estimate and is only used to estimate the contract value and calculate the offer price.
5. Settlements for collected electricity will take place in accordance with the settlement period used by the Distribution System Operator, to which the Purchaser / Payers' electricity consumption points are connected. The Contractor will receive remuneration for the implementation of the Agreement in the amount of the product of the net price for 1 kWh and the amount of electricity consumed based on the indications of the metering and billing system, provided to the Contractor by DSO in the given billing period. The Contractor's remuneration will be increased by the VAT tax in due amount.
6. This contract covers the supply of electricity and the provision of electricity distribution services.
7. The contractor will provide active electricity in accordance with the applicable quality standards for customer service, as specified in the executive acts issued on the basis of the Act of 10 April 1997 - Energy Law (Journal of Laws of 2019, item 755, as amended) .
8. The Employer informs that under the subject of the contract, the Contractor is responsible for commercial balancing and must have the status of the Entity Responsible for Commercial Balancing (so-called POB).
ATTENTION!
The entity responsible for commercial balancing must be entered on the POB list with a given Distribution System Operator on the day of submitting the offer.
8. The Purchaser under this subject of the contract provides for the possibility of exercising the option right in the circumstances and time limits referred to below:
In the course of the contract, the Employer reserves the right to increase by 212,365 kWh the total amount of energy specified in Chapter 3 point 4 of the SETC.
