On July 25, 2017, the requirement plan implementation agreement (BUV) was concluded between the federal government and the federal railway infrastructure company (EIU). The agreement came into force on January 1, 2018. A basic idea of the BUV is the determination of the RIU's own funds contributions on the basis of a business assessment of the requirement plan according to criteria specified in the BUV by means of profitability calculations drawn up by the RIU. Due to the fundamental importance of the WR, it is planned to have it checked by a federal expert with regard to the input data, compliance with the specified methodology and the mathematical correctness before a building financing agreement is concluded.
The contractor is to request the economic profitability calculations (WR) prepared by EUI with regard to the factual, methodological and arithmetical.
Check and certify correctness also with regard to the specifications in the BUV and its annexes, as well as checking the traffic volume structures of selected ones.
Profitability calculations. In the event of any deviations, the federal government, as the client, and the EIU must be presented with proposed solutions for further handling.
With regard to the traffic input data, a detailed and reliable control of the quantity structures contained in the EIU's profitability calculations on the basis of the current Federal Transport Infrastructure Plan (BVWP) assessment of the rail requirements plan projects must be carried out. The model-based determination of the operational quantity structures (passenger traffic and rail freight traffic) has to be done by comparing a plan case with the infrastructure measure to be considered and a project-specific reference case without this infrastructure measure. In addition, when determining the appropriate share of own funds of the RIUs on the basis of § 10 BSWAG in the financing of the rail requirement plan, the traffic volume assumptions of selected sub-projects must be examined as part of the profitability calculations submitted by the RIUs.
If a model-based determination of the operational quantity structures of the respective project at the time of the examination should not be able to be clearly separated from other sub-projects, this must be explained in a statement.
If the AN detects errors in the WR or in the traffic volume structure, he clarifies these bilaterally with the IMs, if necessary. In addition, the errors must be documented and corrected. The contractor has to compare his WR with the test results of the model-based control of the traffic effects.
In the event of deviations, suggestions for adjustment are to be made and discussed with the EIU / BMVI and, as a result, a WR corresponding to the BUV is recommended.
The AN prepares a draft test report for the WR commissioned by the AN and finalizes this according to the agreements between the client and the IM. In the test report, the project effect determined, tested and, if necessary, corrected based on the criteria of the BUV, in particular Annex 9.2, is to be shown by the contractor.
A short report / management summary must be submitted with the final test report.
