The contract is for the Contractor to provide the Ordering Party with a comprehensive supply of gaseous fuel in the form of high-methane natural gas (Group E), consisting in the sale of gaseous fuel and provision of the distribution service.

1. The contract is for the Contractor to provide the Ordering Party with a comprehensive supply of gaseous fuel in the form of high-methane natural gas (Group E), consisting in the sale of gaseous fuel and provision of its distribution service, to installations located in the Employer's facilities, hereinafter referred to as Pickups, whose list is included in Annex 2 to the ToR. Attachments to the SIWZ are published on the website of the Ordering Party www.rakszawa.pl.

2. The total amount of gaseous fuel that will be delivered during the period of the Contract to the places of receipt set out in Annex 2 to the ToR, is estimated at 39,289,960 kWh.

3. The volume of gaseous fuel specified in point 2 is the value estimated on the basis of the current consumption. The Ordering Party reserves the right to reduce or increase the total volume of gaseous fuel in relation to the quantity specified in point 2. The Contractor will deliver gas fuel in the period corresponding to the actual demand of the Employer, regardless of the estimated consumption forecast. The Contractor shall not be entitled to any claim for not charging the anticipated quantity of gaseous fuel by the Contracting Authority. Possible change in the estimated consumption specified in point 2 will not result in additional costs for the Ordering Party, in addition to the settlement for the actually used amount of gaseous fuel.

4. The order for gaseous fuel in individual gas months and the contractual capacity contract are set out in Annex 2 to the ToR.

5. The comprehensive supply of gaseous fuel will take place under the conditions specified in the provisions of the Act of 10.4.1997 - Energy Law (uniform text Journal of Laws of 2019, item 755) and in accordance with the Executive Regulations issued to that Act .

6. The service of distribution of gas fuel to the places of receipt will take place through a distribution network belonging to a local DSO - Polska Spółka Gazownictwa Sp. z o. o. with headquarters in Warsaw.

7. Requirements for the Contractor.

The Awarding Entity grants the power of attorney selected in the Contractor's proceedings to:

7.1. termination of the existing comprehensive gas fuel supply contracts, or submission of a declaration terminating comprehensive gas fuel supply contracts in accordance with the agreement of the Parties,

7.2. notification on behalf of the Contracting Authority of a comprehensive gas fuel supply contract to the Distribution System Operator in order to implement the comprehensive gas fuel supply contract concluded,

7.3. carry out all activities and arrangements with the DSO and the existing seller necessary to carry out the seller change procedure and the effective start of a comprehensive gas fuel supply.

8. Quality standards referred to in art. 91 par. 2a:

8.1. in accordance with the ordinance of the Minister of Energy of 24.9.2018 (Journal of Laws of 2018 item 1814) amending the ordinance on detailed conditions of gas system operation. The quality standards are specified in particular in Chapter 8 of the Regulation: "Quality parameters of gaseous fuels, quality standards of customer service and the manner of handling complaints";

8.2. discounts for failure to meet the quality standards of customer service and discounts for failure to meet the quality parameters of gaseous fuels, in accordance with the Tariff of OSD Polish Spółka Gazownictwa Sp. z oo with its registered office in Warsaw, approved by the President of the Energy Regulatory Office on 25.1.2019 by decision No. DRG.DRG-2.4212.50.2018.AIK.

8.3. discounts for failure to meet the quality standards of customer service in accordance with the Contractor's Tariff.
