Description:

The subject of the contract is the supply of electricity in the period from 1.7.2019 to 30.6.2020 up to 365 consumption points (PPE) with a total estimated volume (+/- 10%) 3,556.76 MWh, of which: zone I 1.943 , 78 MWh; zone II 1,310.31 MWh; zone III 302.67 MWh.

1. The subject of the contract is the supply of electricity in the period from 1.7.2019 to 30.6.2020 up to 365 consumption points (PPE) with a total estimated volume (+/- 10%) 3,556.76 MWh, of which zone I 1,943.78 MWh; zone II 1,310.31 MWh; zone III 302.67 MWh. The forecasted electricity consumption indicated above is indicative and may differ from the amount of energy actually consumed during the contract period. Reducing or increasing the amount of energy consumed does not entail any consequences for the contracting parties (recipients), except for the need to pay for the energy actually consumed at the rates specified in the contract.

2. Quality standards: The subject of the contract is the supply of electricity with specified quality standards in accordance with applicable regulations - Regulation of the Minister of Economy and Labor of 20.12.2004 on detailed conditions for connecting entities to power networks, network operation and operation, specifying among others technical parameters of electricity. The quality standards of electricity are described in the Act of 10.4.1997 - Energy Law and in the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the functioning of the power system. The principles of shaping and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Energy of 29.12.2017.

3. The following reference periods are customarily used: tariff group C1x, Gx, R - 2 (two) months; tariff group C2x, Bx - 1 (one) month. The measuring systems with the tariff group B are adapted to the procedure of changing the seller.

4. Distribution services will be provided on the basis of separate contracts concluded between the awarding entities (electricity consumers - hereinafter "consumers") and the distribution system operator (DSO).

5. Distribution system operator - as described in Annex 1 to the ToR, column "Distribution System Operator".

6. The contractor, based on the power of attorney, will be obliged to submit electricity sales contracts to the appropriate DSO on behalf of the contracting authority (customers) in accordance with applicable regulations.

Note: The Contractor shall report the consumption points solely on the basis of the data to change the seller provided by the contracting authority (after the conclusion of the electricity sales contract).

7. The condition for starting the supply of electricity within the indicated period is the successful completion of the supplier change procedure, the customer's possession of a valid contract for the provision of electricity distribution services and effective termination / expiry of existing contracts for the sale of electricity / comprehensive contracts:

1) In the case of valid comprehensive contracts or indefinite contracts for the sale of electricity, the contracting authorities (customers) shall submit (in relation to individual consumption points) appropriate statements regarding termination of contracts with effect as of the day preceding the planned date of commencement of deliveries (in Annex 1 to the ToR, column " Delivery period "), and copies of the terminations will be forwarded to the contractor whose tender will be considered the most advantageous.

2) In the case of having timely sales contracts, their validity expires on the day preceding the planned delivery start date.

8. In Annex 1, the column "Change of seller" indicates in relation to which PPE the change of seller will occur for the first time, and in relation to which once again.

1) In the case of collection points, where sales and distribution contracts have already been separated, the contracting authorities (recipients) have distribution contracts concluded for an indefinite period.

2) In the case of collection points, for which the seller will change for the first time, the contractor will make a statement on behalf of the contracting authority resulting in the conclusion of the distribution agreement for an indefinite period or conclude a distribution agreement.
