The order is not reserved for protected labor establishments and its implementation is not limited to employment programs for disabled persons.

The Contractor is bound by the offer from the date of expiry of the deadline for submitting tenders, with the first day of the bid validity period being 28.07.2023. on which the deadline for submission of tenders expires until 25.10.2023.

The Ordering Party does not request a deposit.

The contracting authority does not require any security on due performance of the contract.

List of subjective means of proof for the rump. 1-5:

1. In order to confirm the absence of grounds for exclusion of an economic operator from participation in the procedure:

for the award of a public contract, the contracting authority will demand (ON CALL) from the contractor whose bid will be the highest rated:

1) Information from the National Criminal Register in the scope of:

a) Article 108(1)(1) and (2) of the Public Procurement Law Act of 11 September 2019, hereinafter referred to as the "Act",

b) Article 108(1)(4) of the Act on the prohibition of applying for a public contract as a penal measure,

drawn up not earlier than 6 months before its submission.

If the Information from the National Court Register was issued by an authorized entity in electronic form – it should not be printed, but should be sent directly to the Ordering Party, via the purchasing platform at: https://platformazakupowa.pl/pn/kwp_radom.

The electronic certificate is in the form of a compressed set of three files (in zip format):

xml.xades – a file with the signature of an employee of the Ministry of Justice authorized to issue the certificate;

PDF with visualization of the issued certificate.

In this case, in order for the certificate to be considered correctly submitted and thus as confirming the situation of the contractor with regard to the grounds for exclusion related to the commission of criminal offences, at least the first two compressed files must be transmitted. Do not interfere with the compressed set of files received from KRK and hand it over in its entirety to the Ordering Party. Do not send only a pdf file with a visualization of the issued certificate, because this will be treated as a failure to submit the required certificate. The visualization file, despite the signature annotation, is not a signed file.

2) the Contractor's statement, within the scope of Article 108(1)(5) of the Act, on the lack of belonging to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection (i.e. Journal of Laws of 2021, item 275, as amended), with another Contractor who submitted a separate offer, partial bid or request to participate in the proceedings, or a statement on belonging to the same capital group together with documents or information confirming the preparation of a tender, partial bid or request to participate in the procedure independently of another economic operator belonging to the same capital group

3) the Contractor's statements on the validity of the information contained in the statement referred to in Article 125(1) of the Act, in the scope of the grounds for exclusion from the procedure indicated by the Ordering Party, referred to in:

a) Article 108(1)(3) of the Act,

b) Article 108(1)(4) of the Act, concerning the imposition of a ban on applying for a publ.

In order for the Contractor to confirm the conditions for participation in the proceedings regarding technical or professional capacity, the Contracting Authority shall demand (ON REQUEST) from the contractor whose bid will be the highest rated to be submitted within the time limit set by the Contracting Authority, not shorter than 10 current days as at the date of submission of subjective evidence:

list of services provided – the model is attached as Annexes 9 – 13 to the SWZ performed, and in the case of recurring or continuous services also performed, in the last 3 years, and if the period of conducting business activity is shorter – in this period, together with their value, subject, dates of performance and entities for which the services were performed or are performed, and attaching evidence as to whether those services have been or are being performed properly, the evidence in question being references or other documents drawn up by the entity for which the services were performed and, in the case of repetitive or continuous services, are performed, and if the contractor is unable to obtain these documents for reasons beyond its control, a statement by the contractor; In the case of recurring or continuous benefits, references or other documents confirming their proper performance should be issued within the last 3 months.

Grounds for exclusion referred to in Article 108

1. The Contractor shall be excluded from the procurement procedure, subject to Article 110 (2) of the Pzp:

1.1 Being a natural person who is legitimately convicted of a crime:

(a) participation in an organised criminal group or a union aimed at committing an offence or tax offence referred to in Article 258 of the Criminal Code;

(b) trafficking in human beings referred to in Article 189a of the Criminal Code;

(c) referred to in Articles 228 — 230a, Article 250a of the Criminal Code, and Articles 46 - 48 of the Act of 25 June 2010 on sports (Journal of Laws of 2020 item 1133 and 2021 item 2054) or Article 54 (1) to 4 of the Act of 12 May 2011 on the refund of medicines, foodstuffs of special purpose nutritional and medical devices (Journal of Laws of 2021 items 523, 1292, 1559 and 2054);

(d) the financing of a terrorist offence referred to in Article 165a of the Criminal Code, or the offence of thwarting or obstructing the determination of the criminal origin of money or concealing its origin in question

in Article 299 of the Criminal Code;

(e) of a terrorist nature referred to in Article 115 (20) of the Criminal Code,

or intended to commit that offence;

(f) entrust the performance of work to a minor foreigner referred to in Article 9 (2) of the Act of 15 June 2012 on the effects of entrusting the performance of work to foreigners residing in defiance of regulations in the territory of the Republic of Poland (Journal of Laws, item 769);

(g) against the economic turnover referred to in Articles 296 to 307 of the Criminal Code, the offence of fraud referred to in Article 286 of the Criminal Code, the offence against the reliability of documents referred to in Articles 270 to 277d of the Criminal Code, or a tax offence;

(h) referred to in Article 9 (1) and (3) or Article 10 of the Act of 15 June 2012 on the effects of entrusting the performance of work to foreigners residing in defiance of regulations in the territory of the Republic of Poland,

— or for an appropriate prohibited act specified in the provisions of foreign law.

Grounds for exclusion continue:

1.2 If a sitting member of its management or supervisory body, a partner of the company

in a general or partnership company or a general partner in a limited partnership or a limited joint-stock partnership or a proxy has been convicted of the offence referred to in point 1.1;

1.3 For whom a final court judgment or final administrative decision has been issued

arrears with the payment of taxes, fees or social or health insurance contributions, unless the contractor has paid the taxes, fees or social security contributions due, together with interest or fines, or has concluded a binding agreement on the payment of such debts, as appropriate, before the deadline for the submission of tenders;

1.4 In which the prohibition of applying for public procurement has been ruled legally;

1.5 Where the Contracting Authority may conclude, on the basis of reliable indications, that the contractor has entered into an agreement with other contractors to distort competition,

in particular, if they belong to the same capital group within the meaning of the Act of 16 February 2007 on competition and consumer protection, submit separate offers, partial offers or requests to participate in the proceedings, unless they prove that they prepared these offers or applications independently of each other;

2. The Contractor may be excluded by the Contracting Authority at any stage of the procedure

for the award of a contract.

3. The contracting authority shall exclude the contractor against whom the grounds for exclusion referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with Russia's actions destabilizing the situation in Ukraine (Journal of Laws of the European Union, L. of 2014, No. 229, p. 1, as amended), i.e. contractors acting for or with the participation of:

(a) Russian nationals or natural or legal persons, entities or bodies established in Russia;

(b) legal persons, entities or bodies whose ownership rights are directly or indirectly owned by an entity referred to in point (a) of this paragraph for more than 50 percent; or

(c) natural or legal persons, entities or bodies acting on behalf or at the direction of an entity referred to in points (a) or (b) of this paragraph, including subcontractors, suppliers or entities whose capacities are relied on within the meaning of the Public Procurement Directives, where they account for more than 10% of the value of the contract.

The contracting authority shall exclude a contractor against whom there are grounds for exclusion referred to in Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2023, item 129, as amended), i.e.

a) the contractor and the competition participant included in the lists set out in Regulation 765/2006 and Regulation 269/2014 or entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Article 1(3) of the Act;

b) the contractor and the competition participant whose beneficial owner within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2022, items 593 and 655, as amended) is a person listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a beneficial owner from 24 February 2022, provided that it has been entered on the list on the basis of a decision on inclusion on the list determining the application of the measure referred to in Article 1(3) of the Act;

c) the contractor and participant of the competition, whose parent company within the meaning of Article 3(1)(37) of the Accounting Act of 29 September 1994 (i.e. Journal of Laws of 2023, item 120, as amended) is an entity listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a parent company from 24 February 2022, provided that he was entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Article 1(3) of the Act.

In order to confirm the absence of grounds for exclusion under Article 5K of Regulation 833/2014 and Article 7(1) of the Law on special arrangements for counteracting support for aggression against Ukraine and serving the protection of national security (i.e. Journal of Law 2023, item 129 of póź.zm) ) the contractor submits a self-declaration.

Continuation concerning the submission of subjective means of evidence concerning tasks 1-5:

1. If the Contractor has its registered office or place of residence outside the Republic of Poland, instead of:

1) information from the National Criminal Register referred to in Chapter XIX, point 1, point 1, shall submit information from the relevant register, such as the court register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the economic operator has its registered office or place of residence, in the scope referred to in Chapter XIX, point 1, point 1.

2) the document referred to in point 9 point 1) should be issued no earlier than 6 months before its submission.

2. If the documents referred to in point 9(1)(1) are not issued in the country where the Contractor has its registered office or place of residence, or if these documents do not refer to all the cases referred to in Article 108(1)(1), (2) and (4) of the Act, they shall be replaced in whole or in part by a document containing the Contractor's statement, respectively, with an indication of the person or persons authorised to represent it, or a declaration of the person to whom the document was to relate, made under oath, or, if there are no provisions on declaration on oath in the country in which the Contractor has its registered office or place of residence, made before a judicial or administrative authority, notary public, professional or economic self-government body competent for the seat or place of residence of the Contractor. The provision of point 9(2) shall apply.

1) The Contracting Authority shall require the Contractor, which relies on the technical or professional abilities or financial or economic situation of entities providing resources on the terms set out in Article 118 of the Act, to present subjective means of evidence referred to in Chapter XIX, point 1, points 1 and 3, concerning these entities, confirming that there are no grounds for exclusion from the proceedings against these entities.

2) The Contracting Authority requires the Contractor to present subjective evidence,

referred to in Chapter XIX, point 1, points 1 and 3, concerning subcontractors who are not entities providing resources on the principles set out in Article 118 of the Act, confirming that there are no grounds for exclusion from the proceedings against these subcontractors.

4. To entities providing resources on the principles set out in Article 118 of the Act, having their registered office or place of residence outside the territory of the Republic of Poland, the provisions of points 9 and 10 shall apply.
