1.The subject of the contract is the delivery of perpetual licenses for the Polish Academy of Sciences divided into four parts.

Part 1 The subject of the order is the delivery of server licenses (EDU) MS Windows Server 2022 Datacenter per Core – 276 pcs. license or equivalent. A detailed description of the subject of the contract for part 1 is contained in Annex 1a to the SWZ.

Part 2 The subject of the order is the delivery of licenses (EDU) MS Windows Server 2022 RDS - User CAL - 1000 pcs. license or equivalent. A detailed description of the subject of the contract for part 2 is contained in Annex 1b to the SWZ.

Part 3 The subject of the order is the delivery of licenses (EDU) MS SQL Server Enterprise Core 2019 – 16 pcs. license or equivalent. A detailed description of the subject of the contract for part 3 is included in Annex 1c to the SWZ.

Part 4 The subject of the order is the delivery of a license (EDU) MS Windows Server 2022 User CAL – 1000 pcs. or equivalent. A detailed description of the subject of the contract for part 4 is included in Annex 1d to the SWZ.

1.The subject of the contract is the delivery of perpetual licenses for the Polish Academy of Sciences divided into four parts.

2. The place of delivery of the subject of the order for each part of the order is the seat of the Ordering Party.

3.Equivalent solution, applies to each part of the contract. Wherever the subject of the contract is described by indicating trademarks, the Ordering Party allows the Contractor to use solutions equivalent to those described, provided that they have at least the same or better technical and functional parameters – indicated in Annex 1a to the SWZ for part 1 of the contract and do not lower the standards specified in the SWZ. In the event that the Contractor proposes equivalent products, it is obliged to demonstrate and attach to the tender a list of all the proposed equivalent elements and demonstrate their equivalence in relation to the elements described respectively in Annex 1a of the SWZ for part 1 of the contract.

4. The Ordering Party requests the Contractor to indicate in the Offer Form the part of the contract which it intends to entrust to subcontractors and to provide the names of any subcontractors, if they are already known.

5. The Contracting Authority does not reserve the obligation for the Contractor or individual Contractors jointly applying for the award of a public contract to perform key tasks in person.
