The Framework Agreement has as its object the performance of the activity of Systematic Reclamation of Explosive Devices Remnants of War for the interventions of competence of the Administration affected by excavation activities. The specific procedures for carrying out the systematic remediation service from remnants of war are detailed in the technical descriptive and performance specifications available in the tender documents.
As established by art. 4 of the Special Specifications, the economic value indicated for the Framework Agreement does not constitute an indication of contractual consideration, but quantifies a presumed tender requirement for the formal obligations linked to this value. The Framework Agreement pursuant to art. 54 of the Code constitutes in fact a contractual instrument for the regulation of the stipulation of any and future "implementing contracts", not predetermined for number, amount and location, which will be entrusted by the contracting authority during the duration of the Framework Agreement and according to the needs and priorities identified by the Administration. The stipulation of the Framework Agreement is therefore not a source of immediate obligation between the Metropolitan City and the contractor and is not binding with regard to the assignment to the latter of the "implementing contracts" for a predefined minimum quantity. The individual "implementation contracts" take the form of Service Orders (SO) and are intended to be entrusted with their receipt by the contractor. Each Service Order will describe the intervention to be performed and will establish the amount, the start date and the maximum completion date. The SOs will be communicated in the manner indicated in the Special Specifications.
