The subject of the contract is the transport and care of disabled students during transport from home to school and back, in the school year 2023/2024. The proceedings are not divided into parts. A detailed description of the subject of the contract can be found in Annex 1 to the SWZ and in the Draft provisions of the contract.
The subject of the contract is the transport and care of disabled students during transport from home to school and back, in the school year 2023/2024.
1. Provision in the school year 2023/2024 of transport services for transporting disabled children living in the Bemowo District to schools and educational institutions
on the home-school-home route with providing them with care during transport.
2. Transport is provided to disabled children attending kindergartens and primary schools
and secondary schools and other institutions listed in Article 2(7) of the Act of 14 December
2016 Law on School Education (i.e. Journal of Laws of 2021, item 1082, as amended).
3. The deadline for the implementation of the subject of the contract is set for a period of 12 months, i.e. from 4 September 2023 to:
August 31, 2024
4. The delivery service is provided in accordance with the provisions of § 3 of the contract, i.e. in accordance with the calendar of the school year 2023/2024, it also takes into account the winter holidays and other breaks during the school year.
5. Illustrative list of transport routes for disabled children from the Bemowo District transported by the carrier in the year szk. 2023/2024, constitutes an attachment to the OPZ and was prepared by the Contracting Authority according to the state of knowledge as at the date of initiation of the proceedings. After signing the contract with the selected Contractor, it will be updated in case of any changes in the number of children and routes.
6. The Contractor shall be obliged to:
1. ensure the transport of:
(a) disabled children adapted for that purpose by appropriately marked cars:
- equipped with specialized equipment (lifts or platforms, rails and belts for attaching trolleys in the floor of the vehicle and belts at the seats) – in the amount of at least 5 pcs.
- appropriately marked vehicles adapted for the transport of disabled people - in the amount of at least 4 pcs.
- in the event that the Contractor will provide the service using more than one of the cars referred to above, each subsequent one must meet the requirements specified
in OPZ. Then the contractor will be obliged to present a schedule for the delivery of children to each subsequent car used to provide the service.
(b) provide for the transport of wheelchairs;
c) provide transport of children in cars not older than those produced in 2014.
The Ordering Party does not allow the service to be provided with cars older than those manufactured in 2014.
The Ordering Party does not allow the provision of the service of cars adapted to specialized transport other than the description of the subject of the contract (e.g. ambulances, sanitary cars, cars transporting hospital patients, dialysis patients and carrying biological material).
2) Contractor in the fleet of motor vehicles within the meaning of Article 2 point 33 of the Act of 20 June 1997. The Road Traffic Law when performing the above service is obliged to ensure at least 10% share of electric vehicles or vehicles powered by natural gas, i.e. 1 car (Article 68 paragraph 3 in conjunction with Article 68 b point 3 letter b of the Act of 11 January 2018 on electromobility and alternative fuels (i.e. Journal of Laws of 2022, item 1083, as amended). The car must be properly marked, i.e. have a sticker or plate proving the transport of disabled people (Article 58 of the Road Traffic Act).
3) after receiving lesson plans, determine the optimal schedule of transport of children, taking into account the shortest possible time of stay of disabled children on the journey and taking them to the educational institution at such a time that it is possible for them to start classes on time (in accordance with the curriculum) and take them after the end of classes (in accordance with the curriculum) without unnecessary waiting.
