The subject of the Order is the performance of the service entitled "Repair of the P5 maintenance level of DH-350.11 hydraulic draisines".
The subject of the Order includes the repair of nw. vehicles: 1) hydraulic trolley DH-350.11 (with crane), fabr. 007/2014, 2) hydraulic trolley DH-350.11, nr fabr. 008/2014, 3) hydraulic trolley DH-350.11, no. fabr. 009/2014. The subject of the Order additionally includes the installation of the hydraulic crane F95AF.0.24.E on hydraulic draisines DH-350.11 with the number fabr. 008/2014 and 009/2014 and carrying out in accordance with Commission Regulation (EU) No 402/2013 by the Contractor the process of assessing the significance of the change for each of the above-mentioned trolleys regarding the crane construction together with providing the Contracting Authority with a report on the above-mentioned assessment.
The detailed scope of the Subject of the Order is described in the Technical Specification, which together with Annexes No. 1-9 constitutes Annex No. 1 to the SWZ ("ST").
The Contractor shall provide a 24-month warranty for trouble-free operation of hydraulic trolleys after the repair, starting its course upon signing the "Rolling Stock Acceptance Protocol after repair" (Appendix No. 9 to ST) for each trolley separately.
The Contracting Authority requires employment, on the basis of an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended), by the Contractor or Subcontractor, of all persons performing the above. Activities related to the implementation of the contract: a) disassembly, assembly and cleaning of components of hydraulic draisine assemblies and subassemblies, b) replacement of the required parts necessary to perform the repair of assemblies and subassemblies, c) all activities related to the installation of the crane on the vehicle, d) activities related to refreshing and mapping the paint coating, e) performing the required tests and measurements.
The contracting authority requires the submission of a bid after the on-site inspection referred to in Article 131(2) of the PPL, taking into account the principles set out in point 4.6 of the SWZ. The Contractor's lack of participation in the on-site inspection will result in the rejection of its bid pursuant to Article 226(1)(18) of the PPL.
The Contractor is obliged to secure the bid bond submitted by him in the amount of PLN 24,000.00 in the manner specified in point 13 of the SWZ.
The date of commencement of the implementation of the Subject of the Order is the date of conclusion of the Agreement, except that the Contractor will repair the hydraulic trolley DH-350.11, fabr. 007/2014 within 50 calendar days from the date of receipt for repair, and repair of hydraulic draisines DH-350.11, no. fabr. 008/2014 and 009/2014 – within 220 calendar days from the date of receipt for repair, with the collection of hydraulic draisines DH-350.11, no. fabr. 008/2014 and 009/2014 after the repair will not take place earlier than 08.01.2024.
The Contractor shall collect the trolleys from the Ordering Party for repair within 10 working days from the date of conclusion of the Agreement.
