The order concerns the construction of a building for socio-cultural purposes for the needs of the inhabitants of the Bialski District in the design and build formula. The implementation of the project will allow for the creation of a modern, tailored to the needs of users and customers (residents of the Bialski poviat) public infrastructure, ensuring a high level of services provided. The building will be adapted to the needs of people with disabilities, will be fully accessible and functional. The location of the planned building is plot No. 2260/6 located in Biała Podlaska, precinct 1, at 41 Brzeska Street. In the existing state at the site of the planned investment, there is an above-ground car park with accompanying infrastructure, a green area and an unused fuel warehouse.
1. As part of the project, a building for socio-cultural purposes will be built in the centre of Biała Podlaska, on a property belonging to the Biała Podlaska poviat. It will house public institutions providing services to residents and the District Cultural Centre, which will focus cultural activities carried out in the Bialski poviat. As part of the investment, m.in will be carried out: earthworks and foundations, masonry and reinforcement works, insulation works, flashings, window and door joinery, partition walls, finishing works, façade execution, painting, flooring and cladding, heating and sanitary installations, electrical works. During construction, modern construction technologies will be used, allowing to reduce the operating expenses of the building, protection of the natural environment. The project will be implemented in accordance with the principle of sustainable development policy, equal access to the created infrastructure and the principle of universal design. The implementation of the project will allow for the creation of a modern, tailored to the needs of users and customers (residents of the Bialski poviat) public infrastructure, ensuring a high level of services and service for people from disadvantaged groups. The building will be adapted to the needs of people with disabilities, will be fully accessible and functional. The investment is fully feasible, the beneficiary has the right to the property and the construction concept.
2. The proceedings are conducted in the design and build formula. A detailed description of the subject of the contract can be found in the Functional and Utility Program constituting Annex 1 to the SWZ.
3. Pursuant to Article 95(1) of the Act, the contracting authority shall specify the following requirements concerning the employment by the contractor or subcontractor on the basis of an employment contract of persons performing activities indicated by the contracting authority, in the scope of performance of the contract, the performance of which consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974. Labour Code (Journal of Laws of 2022, item 1510, as amended):
1) the type of activities necessary for the performance of the contract, which require employment under an employment contract by the contractor or subcontractor, persons performing activities during the performance of the contract: activities directly related to the performance of works, i.e. the so-called technical and organizational works at the design stage and physical workers – at the stage of conducting construction works (the requirement does not apply to, m.in. designers, persons managing the construction site, performing geodetic services or suppliers of materials),
2) the method of documenting the employment of persons referred to in Article 95(1) of the Act – within five working days from the date of signing the contract, the Contractor shall submit to the Contracting Authority a statement that persons performing activities directly related to the performance of works are employed under an employment contract, both by the Contractor and any subcontractors.
A detailed description of the requirements specified in Article 95(1) of the Act is described in Chapter XXIV of the SWZ and the draft provisions of the agreement constituting Annex 3 to the SWZ.
4. Pursuant to Article 257 of the Law, the contracting authority provides for the cancellation of the procurement procedure if the public funds which the contracting authority intended to allocate to finance all or part of the contract are not awarded to it.
5. The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) in the scope of construction works related to the construction of a building for socio-cultural purposes for the needs of residents of the Bialski District not included in the procurement documents, the need for performance of which may arise during the performance of the basic contract in the amount of up to 30% of the value of the basic contract and under the conditions provided for the basic contract.
