I. DESCRIPTION OF THE SUBJECT OF THE CONTRACT
1. As part of the performance of the subject of the contract, the Contractor shall be obliged to:
1.1. in the summer period from 1 April to 31 October each year, during the term of the maintenance agreement, 389,527 km of roads (including 15,055 km of intra-residential roads) - the list of roads for summer maintenance is attached as Annexes 1 and 7 to the Agreement - the detailed scope is indicated in §2 section I point 1 of the draft agreement;
1.2. in the winter period from 1 November to 31 March each year, during the term of the contract, the Contractor is obliged to:
1.2.1. During active action:
1.2.1.1. snow removal and combating winter slippery 407,751 km of roads (including 15,055 km of residential roads) - the list of roads for winter maintenance is attached as Annexes 2 and 7 to the Agreement - the detailed scope is indicated in §2 section II points 1.1 and 1.3 of the draft agreement;

1.2.1.2. winter maintenance of alleys, sidewalks, bicycle paths and parking lots with a total area of 806,280 m2 (including 224,359 m2 of intra-estate areas) - the list of alleys, sidewalks, bicycle paths constitute Annexes 3 and 5 to the Agreement, and the list of parking lots constitute Annexes 4 and 6 to the Agreement
- the detailed scope is indicated in §2(II)(1.2) and (1.3) of the draft contract;
1.2.2. During the passive action when there are no winter conditions, the Contractor is obliged to perform the following activities:
1.2.2.1. in the scope of cleaning roads listed in Annex 8 of the Agreement - the detailed scope is indicated in §2 section II point 2.1. of the draft agreement;
1.2.2.2. in the scope of cleaning alleys, sidewalks, bicycle paths and parking lots listed in Annexes 9 and 10 to the Agreement - the detailed scope is indicated in §2 section II point 2.2. of the draft agreement;
1.2.2.3. remain in the so-called readiness to act to the extent indicated in §2 section II point 2.3. of the draft contract;
1.3. implementation of additional works - to the extent indicated in §2 section III. of the draft contract.
2. During the term of the entire contract, the Contractor shall have:
2.2. warehouse and transport base of Dąbrowa Górnicza at a distance of no more than 20 km from the borders
administrative of the Municipality of Dąbrowa Górnicza, meeting the conditions set out in §2 section IV point 1 of the draft contract;
2.3. an electronic meteorological station located in the Municipality of Dąbrowa Górnicza, enabling 24-hour monitoring of weather conditions and meeting the conditions set out in §2 section IV point 2 of the draft contract.
Other requirements for the implementation of the subject of the contract are included in §2 and §3 of the draft contract constituting Annex 11 to the SWZ.
II. ENVIRONMENTAL ASPECT OF THE CONTRACT
1. The Contracting Authority indicating the environmental management measures that the Contractor will apply during the performance of the service by:
- determination of the emission standard of vehicles used in the performance of the contract in Chapter II, point II, point 2 of the SWZ
- the obligation to have a storage and transport base of Dąbrowa Górnicza at a distance of no more than 20 km from the administrative borders of the Commune of Dąbrowa Górnicza specified in Chapter II, point I, point 2.2. SWZ
requires that the services being the subject of the contract be performed by the Contractor applying practices, procedures, processes and resources to maintain continuous improvement of the effectiveness of environmental policy and management of environmental aspects in a manner that reduces negative impact on the natural environment.
The subject of the contract should be carried out using the implemented environmental management system meeting the requirements of Regulation (EC) No 1221/2009 of the European Parliament and of the Council (DZ. U.EU L.2009.342.1) on the voluntary participation of organisations in an eco-management and audit scheme within the EMAS community or using an implemented environmental management system based on European or international standards certified by bodies operating in accordance with European Union law, European or international standards for certification (e.g.ISO 14001) or other equivalent environmental management scheme.
2. The Ordering Party requires that at least 50% of vehicles used in the execution of the contract meet the EURO 6 emission standard, while all others should meet the standard of min. EURO 5.
3. The Contracting Authority obliges the Contractor to perform the contract in a manner consistent with the Act of 11 January 2018 on electromobility and alternative fuels (i.e. Journal of Laws of 2022, item 1083, as amended) and any amendments thereto.
4. The share of electric vehicles or vehicles powered by natural gas in the fleet of vehicles used in the execution of the contract will amount to at least 10% in accordance with Article 68 paragraph 3 of the Act of 11 January 2018 on electromobility and alternative fuels (i.e. Journal of Laws of 2022, item 1083 with późn.zm) and its possible changes - i.e. min 1 vehicle.
