4.1. The subject of the order is the delivery and installation of photovoltaic installations in the territory of the municipality of Nowosolna. The object of the order is to draw up the technical documentation, followed by the delivery, assembly and commissioning of 82 kpl photovoltaic sets with a power of 3,06 kWp each. Photovoltaic installations will produce electricity for the user's own needs. In addition, on the Contractor's side, the preparation of the necessary post-construction documentation and the preparation and transfer to the local power plant applications for the installation of two-way electricity meters.
4.2. A detailed description of the item of the order is set out in the Functional-Utility Programme of Annex 2a to SWZ.

The object of the order is to draw up the technical documentation and then on the basis of the delivery, assembly and commissioning of 82 kpl photovoltaic sets with a power of 3,06 kWp each. Photovoltaic installations will produce electricity for the user's own needs. In addition, on the Contractor's side, the preparation of the necessary post-construction documentation and the preparation and transfer to the local power plant applications for the installation of two-way electricity meters.
4.2. A detailed description of the item of the order is set out in the Functional-Utility Programme of Annex 2a to SWZ.
4.3. Delivery includes equipment factory new and not used.
4.4. The Contractor should anticipate and price in its offer that approximately 10% of the plant will be installed on the ground.
4.5. The Contracting Authority does not allow partial tenders (the order is not divided into parts due to the fact that the subject of the contract constitutes one inextricable whole and cannot be divided into parts for technical and functional reasons).
4.6. Under the term supply of equipment shall be understood to provide at own expense and risk the object of the order required by the Ordering Party, its installation in the place indicated by the user with the commissioning of all devices, verifying their correct operation and giving them the correct operation configuration and training the user.
4.7. Delivery of the object of the contract co-financed under the project: “Increasing the production of renewable energy in the territory of the municipality of Nowosolna” from the European Union in the framework of the European Regional Development Fund of Łódź Voivodeship for the period 2014-2020.
4.8. The Contracting Authority does not provide for option tenders.
4.9. The contracting authority does not intend to enter into a framework agreement.
4.10pm. The Contracting Authority does not intend to establish a dynamic purchasing system.
4.11. The Contracting Authority does not intend to select the most favourable bid using electronic auction.
4.12pm. The Contracting Authority shall allow equivalent tenders to be submitted for individual items of the subject of the contract. The equivalent offer is an item with the same or better technical, quality, functional parameters meeting the minimum parameters specified by the Ordering Party in Annex 2 to SWZ (assortment and price sheet). In this case, the Contractor shall provide, together with the offer, a detailed specification in which, in a way that is unmistakable to doubt the Contracting Authority, that the assortment offered is of the same technical, qualitative, functional parameters with respect to the assortment specified by the Ordering Party in the description of the item of the order The Contracting Authority shall inform that where trademarks are found in the description of the subject of the contract, an equivalent offer shall be considered to meet the parameters of the individually indicated assortment set out by its manufacturer.
4.13. In accordance with Article 139 of the Act, the Contracting Authority will first examine and evaluate tenders and then make the qualification of the Contractor whose offer will be highest assessed in the absence of grounds for exclusion and fulfilment of the conditions of participation in the proceedings.
4.14. If there are grounds of exclusion to the Contractor referred to in point 4.13, the Contractor does not comply with the conditions for participation in the proceedings, shall not submit the evidence or declaration referred to in Article 125 (1) of the Act confirming the absence of grounds for exclusion or fulfilment the conditions of participation in the proceedings, the Contracting Authority shall reexamine and evaluate the tenders of the other Contractors, and shall then qualify the subject of the Contractor whose offer has been highest assessed in the absence of grounds for exclusion and fulfilment of the conditions for participation in the proceedings.
