The object of the contract is the maintenance and development of the SIOEPKZ IT system, including development work and accompanying services, i.e. the provision of the basic procurement and the right of options for traffic maintenance and development services, including the implementation of modifications related to the development of an IT system for the handling of vocational examinations implemented and functioning in CKE, hereinafter referred to as “SIOEPKZ”.
A. Introduction and General Order Scope (OPZ)
1. The subject of the contract is the provision, within the framework of the basic contract and the right of options, of maintenance and development services, including the implementation of modifications related to the development of the IT system implemented and functioning in the CKE of the professional examination system, hereinafter referred to as “ SIOEPKZ”.
2. By keeping in motion, it is meant:
1) ensuring the availability and correct operation of the SIOEPKZ system, as well as the execution of orders provided by the contracting operator for the operation of that system, in accordance with the parameters indicated herein;
2) reporting on the availability of the system and the scope of activities performed during the monthly billing periods according to the information scope set out in Chapter D.13 of the OPZ;
3. Acquisition of guarantee obligations relating to the SIOEPKZ system — detailed warranty provisions are defined by Chapter D.9 of OPZ;
4) audits of system infrastructure and software applications — up to 2 audits during the period of implementation of the contract in accordance with the provisions of Chapter D.15 of the OPZ;
5) carry out training for system users in the scope and mode (stationary or remote) agreed with the contracting authority.
Number of training envisaged: 12 training days per calendar year, and if the service delivery period in a given calendar year is shorter, the number of training days equal to the number of full months of service delivery in a given calendar year. The Contracting Authority shall be entitled to carry out training from the first working day of the calendar year concerned.
3. By making modifications, it is understood:
1) modifying and updating the SIOEPKZ system to ensure its compliance with current law in accordance with Chapter D.7 of OPZ;
2) development work and accompanying services related to the development and implementation of modifying/extending the functionality of the SIOEPKZ system;
3. Programming and accompanying services related to the development and implementation of modifying/extending the functionality of the SIOEPKZ system in order to ensure its cooperation with another IT system;
4) the introduction of functionalities in the SIOEPKZ system to support other exams than those currently supported;
5) make configuration changes to the SIOEPKZ system not covered by the scope described in point A.2 (also in terms of changes to the configuration of the hardware or system infrastructure).
4. The basic order includes:
1. For the services referred to in point A.2, the provision for a period of 45 months from the date of signing the contract, but not earlier than 1 January 2022;
2) for the services referred to in point A.3, up to a range of 15,000 man-hours between 1 January 2022 and the end of the term of the contract.
5. Options law includes:
1) for the services referred to in point A.2 for a period of 3 months from the date of completion of the basic contract;
2) for the services referred to in point A.3, up to the range of 60,000 man-hours throughout the duration of this Agreement.
6. The Contracting Authority is entitled to run the option right:
1) for the services referred to in point A.2 for a period of 3 months or less, the right of option may be triggered repeatedly until the total pool of 3 months is exhausted;
2) for services referred to in point A.3, up to a range of 60,000 man-hours, the right of options can be run repeatedly until a total pool of 60,000 man-hours is exhausted.
The Contractor who takes part in the procurement procedure shall be excluded from the proceedings in cases referred to in Article 108 (1) and Article 109 (1) (4), (9) subject to Article 109 (3) and Article 110 (2) and (3) of the Pzp Act.
The Contracting Authority shall invalidate the proceedings if the public funds which the Contracting Authority intended to allocate to the financing of all or part of the contract have not been granted to it (Article 257 of the Pzp Act).
