1.The subject of the contract includes the supply of various sports equipment in accordance with the division of the contract into parts for HWS URANIA under the project no. RPWM.08.01.00-28-0001/20, entitled: "Reconstruction and extension of the Urania sports and entertainment hall in Olsztyn".
2. A detailed description of the subject of the contract is included in Annex No. 1 to the SWZ Description of the subject of the contract (separately for each of the parts from 1 to 15),
3. The parameters and requirements indicated in the OPZ define the minimum technical, operational, utility, quality and functional conditions to be met by the subject of the contract delivered to the contracting authority.
Supply of equipment for sports on sports fields or courts1. The entire delivered assortment and its elements must meet the specification specified in the Description of the Subject of the Order (OPZ), and in particular must:
(a)be produced no earlier than 2022;
(b)be brand new, not previously the subject of exhibitions or exhibitions, technically sound, free from external defects, complete and ready for use, for their intended purpose;
c) comply with the conditions resulting from applicable law and applicable industry quality standards and norms for this type of assortment;
d) have all legally required certificates, approvals, permits, etc. allowing them to be used;
e) have full documentation and accessories that are necessary for use, i.e. in particular: operating and maintenance instructions (if applicable), declaration of conformity, warranty conditions, all documents must be drawn up in Polish (accessories are understood as all devices that are necessary for proper current operation, if the accessories require permanent assembly, the Contractor undertakes to deliver and install them).
2.The contracting authority allows the submission of equivalent bids in accordance with Article 99(5) of the Public Procurement Law and Article 101(4) of the Public Procurement Law, however, the requirements and technical parameters specified by the contracting authority defining the subject of the contract are the minimum conditions that the contracting authority will expect to be met. A contractor who relies on equivalent solutions is obliged to demonstrate that the solution offered by it meets the requirements specified by the contracting authority. In this case, the contractor shall attach to the tender a list of equivalent solutions, as appropriate, together with its description or standards.
