1. The subject of the contract is the supply of electricity for facilities listed in Annex 1 to the SWZ – description of the subject of the contract. Electricity demand in the period from 01.01.2024 until 31.12.2024 is: 1 999 050 kWh (basic order). The volume was calculated on the basis of estimated and forecasted consumption.

2. In the description of the subject of the contract (Annex No. 1 to the SWZ), the Contracting Authority provided information on the planned dates of installation of photovoltaic installations. Energy consumption points (PPE) will be successively excluded from the electricity sales agreement and comprehensive agreements will be concluded. The Ordering Party reserves the right to extend the execution of the installation and thus the date of shutdown will be postponed.

3. In the course of the execution of the order, the Ordering Party reserves the right to reduce or increase the amount of electricity in the range of up to +/-15% in relation to the amount of energy specified above.

3. In the course of the execution of the order, the Ordering Party reserves the right to reduce or increase the amount of electricity in the range of +/-15% in relation to the amount of energy specified above:

1) the increase in the amount of energy will take place on the basis of the right of option. The rules, scope and manner of exercising the option right by the Ordering Party are described in § 1 section 5 point 1 of the Project provisions of the contract according to Annex 2 to the SWZ,

2) the amount of energy will be reduced on the basis, to the extent and manner described in § 1 section 5 point 2 of the Project provisions of the agreement according to Annex 2 to the SWZ.

4. The detailed scope of the contract is defined in Annex 1 to the SWZ, in accordance with the provisions of the Act of 10 April 1997. Energy law Other conditions regarding the performance of the contract are set out in the draft provisions of the electricity sale agreement – Annex 2 to the SWZ.

5. Electricity will be supplied under the conditions specified in the provisions of the Energy Law Act of 10 April 1997 and in accordance with the implementing regulations issued to this Act, in particular with the customer service quality standards set out in the Regulation of the Minister of Climate and Environment of 29 November 2022. on detailed rules for the formation and calculation of tariffs and settlements in electricity trading. The quality parameters of electricity in the distribution part are regulated by the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system.

6. Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the relevant Distribution System Operator (referred to as DSO) – DSO data are included in Annex 1 to the DSO. The reserve seller is: Enea SA.

7. The requirements (obligations) for the Contractor are described in the draft provisions of the sales contract constituting Annex 2 to the SWZ. The performance of activities resulting from the proposed provisions of the contract will take place on the basis of a power of attorney that will be granted to the contractor by the contracting authority.

8. Annex 1 of the SWZ provides information on current parameters (tariff group) that may be subject to change during the term of the electricity contract.

9. Number of contracts for the supply of electricity to be concluded by the Contracting Authority with the contractor selected in these proceedings: 3 contracts according to the Buyer given in Annex 1 to the SWZ.
