The subject of the order is the purchase of electricity with a total estimated volume of 59 502.7 MWh (+/- 10%) during the supply period, i.e. from 1.1.2020 to 31.12.2020. Supply of electricity will take place for the purposes of facilities classified into 2 groups according to the following classification:

- group 1 - street lighting,

- group 2 - premises and facilities other than street lighting.

1. The subject of the contract is: the purchase of electricity with a total estimated volume of 59,502.7 MWh (+/- 10%) during the delivery period, i.e. from 1.1.2020 to 31.12.2021. Supply of electricity will take place for the purposes of facilities classified into 2 groups according to the following classification:

- group 1 - street lighting,

- group 2 - premises and facilities other than street lighting.

2. Detailed description of the subject of the contract, among others a list of consumption points along with tariff groups, contracted capacities and planned amounts of electricity consumption is included in Annex 6 to the ToR.

3. The Contractor shall make all activities and arrangements with DSOs necessary to carry out the procedure of changing the seller and effective start of the sale of electricity, including in particular: termination of existing comprehensive agreements, notification of new electricity sales agreements to DSO. The Contractor will perform these activities on the basis of appropriate powers of attorney granted along with the conclusion of electricity sales contracts.

4. Expected electricity consumption is binding and serves to compare bids, the Contractor should allow cost-free deviations from the expected consumption by at least 10% in total for the entire volume. The indicated tolerance regarding the volume being the subject of the order should be understood as the option right within the meaning of the provisions of art. 34 section 5 of the PPL Act.

5. The sale of energy will take place on the basis of contracts concluded separately by individual Ordering Parties, whereas with respect to Ordering Parties: Andrychów Commune, Babice Commune, Brzeszcze Commune, Brzeźnica Commune, Chełmek Commune, Kalwaria Zebrzydowska Commune, Oświęcim Commune, Mucharz Commune Osiek, the Commune of Polanka Wielka, Commune of Przeciszów, Commune of Spytkowice, Commune of Stryszów, Commune of Tomice, Commune of the City of Trzebinia, Commune of Wadowice, Commune of Zator, Poviat of Chrzanowski, Poviat of Oświęcim, Poviat of Wadowicki also on the basis of contracts concluded separately by local government organizational units, which will be separate payers, which are described in detail in Annex 6 to the ToR.

6. Electricity distribution services will be provided on the basis of separate contracts concluded with local distribution system operators.

7. The implementation of the subject of the contract will take place in accordance with the provisions of the Energy Law and executive acts issued on its basis.
