The subject of the contract is the transport and care of 102 disabled students (including five-year and six-year-old children) residing in the Targówek District of the Capital City of Warsaw Warsaw during transport to kindergartens, schools or other squares. dim. in art. 2 clause 1, 2 and 7 of the Act of 14.12.2016 Education Law. (Journal of Laws of 2019, item 1148, as amended) on the home-school-home route during the school year: 2019/2020, i.e. from the date of the conclusion of the contract, but not earlier than from 1.1.2020 to 31.8. 2020), 2020/2021 (from 1.9.2020 to 31.8.2021), 2021/2022 (from 1.9.2021 to 31.12.2021). The transport will cover children with a disability certificate. and a decision on the need for special education, fulfilling the obligation of pre-school preparation, compulsory education or compulsory education. Employer in accordance with art. 36a para. 2 of the PPL Act reserves the obligation for the Contractor to perform in person the part of the contract that requires a license referred to in the ToR.
The transport will cover children who have a disability certificate and a special education declaration, fulfilling the obligation of pre-school preparation, compulsory education or compulsory education. Deliveries will take place to schools and educational establishments operating in the Capital City of Warsaw, and in justified cases referred to in Article 127 paragraph 15 of the Act of 14 December 2016 on Educational Law (Journal of Laws 2019 item .1148, as amended), also to the nearest special school or center located in the poviats neighboring the city of Warsaw.
The contracting authority in this procedure applies a social clause based on art. 29 paragraph 3a of the Act. The contracting authority requires employment by the Contractor or Subcontractor under an employment contract within the meaning of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2019, item 1040, as amended) of persons performing the following activities indicated by the contracting authority necessary for the implementation of the contract, i.e. work of drivers and supervisors. The above condition will be met through the employment of new employees under the employment contract or the appointment of employees already employed by the Contractor or Subcontractor.
The Employer envisages providing the current Contractor with a service, within 3 years of the award of the basic contract, the contract referred to in Article 67 (1) (6) of the Act, consisting in the repetition of similar services related to increasing the number of transported children.
The value of the order related to the increase in the number of children delivered, compared to the value of the basic order was set at 10%. The contract will be awarded on the terms of the basic contract. The contracting authority provides that the price for the delivery of one child per day may be up to 5% higher than the price of the basic order.
The contract related to the increase in the number of delivered children will cover the scope given in Annex 6 to the ToR.
The contracting authority provides for the application of the procedure referred to in art. 24aa section 1 of the Public Procurement Law (so-called Reverse Procedure). Pursuant to the aforementioned provision, the Employer will first evaluate the offers and then examine whether the Contractor whose offer has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure.
