Description:
Collection and management of municipal waste from inhabited properties and properties with summer cottages in the Uniejów Municipality in 2024.

3.1 The subject matter of the contract includes the collection, transport and management of municipal waste from inhabited properties and properties with summer cottages in the Uniejów commune. As part of the contract, the Contractor is obliged to collect, transport and manage any amount of municipal waste from all inhabited properties and properties with summer cottages, or other properties used for recreation and leisure purposes, used only for part of the year, located in the Uniejów Commune. It is also required to collect waste that has been placed next to bagged bins when it does not fit in the bins. It is also required to collect segregated fractions both in bags and in private containers appropriately marked. As part of the service, the Contractor undertakes to empty bins located at bus shelters in the Town and Municipality of Uniejów. A detailed description of the subject matter of the contract and a list of the locations of bus shelters can be found in Appendix 8 to the Terms of Reference.

3.2 Municipal waste collection. The subject of the contract includes the collection of municipal waste, i.e. municipal waste collected in a non-selective manner (mixed municipal waste), municipal waste collected in a selective manner. Detailed information is included in Appendix 8 to the Terms of Reference.

3.3 The contractor is obliged to estimate the waste stream in individual fractions, taking into account:

3.3.1 the estimates set out in Appendix 8 to this Terms of Reference,

3.3.2 forecasts of the municipal waste stream for rural areas included in the currently applicable Waste Management Plan for the Łódź Voivodeship.

It is anticipated that the volume of waste during the duration of the contract may change.

3.4. Frequency of waste collection. The Contractor will collect municipal waste from properties where residents live and from properties where there are summer houses or other properties used for recreation and leisure purposes (used only for part of the year) at the frequency set out in the schedule approved by the Contracting Authority. Depending on the place of collection and the type of waste, it will be collected once or twice a month, once every six months or after prior notification by phone. In addition, the Contractor undertakes to empty the bins located at the bus shelters at a frequency of not less than once a month. If the bins are filled with waste, the Contractor is obliged to empty the bins by phone at the Contracting Authority's request. The frequency of waste collection is specified in detail in Appendix 8 to this Terms of Reference.

3.5. Organization and maintenance of a municipal selective waste collection point.

3.5.1. By 1 January 2024, the Contractor is obliged to organize, equip, maintain and operate a municipal selective municipal waste collection point. Detailed information is included in Appendix 8 to the Terms of Reference.

The costs of waste management accepted by the Contractor shall be borne by the Contractor.The Contractor is obliged to:prepare and submit annual reports together with photocopies of waste transfer notes confirming the manner of management of a given amount and type of collected waste; keeping records of waste in accordance with the concessions and permits held, as well as waste management documentation established in separate regulations; maintaining a system for recording waste transferred to PSZOK (at least the type and quantity of waste transferred, the origin of waste and the submission of monthly reports specifying the type and quantity of waste accepted, the origin of waste and places of its management); have a valid permit for the activities carried out in PSZOK and related to waste management and notify the Contracting Authority of changes to permits limiting the performance of the obligations assumed; The contractor is obliged to comply with the regulations on environmental protection and traffic safety during the execution of the contract. Fees and penalties for exceeding the standards set out in the relevant environmental regulations during the implementation shall be borne by the Contractor; continuity of service during the term of the contract; performing the subject matter of the contract in a professional manner, not causing unnecessary nuisance and limiting the inconvenience to the public to the necessary minimum; By 1 January 2024, the Contractor is obliged to install computer software on the computer workstation indicated by the Contracting Authority, allowing for ongoing reading of monitoring based on the satellite positioning system, enabling permanent recording, storage and reading of data on the position of vehicles and parking places, as well as sensors recording data on waste unloading places in order to verify the correctness of the provision of the service in accordance with the subject of the contract.bearing full responsibility towards the Contracting Authority and third parties for damage to the property and health of third parties, occurring during and in connection with the performance of the subject matter of the contract. Waste management. The contractor is obliged to manage municipal waste in accordance with the guidelines contained in the detailed description of the subject of the contract. Equipping the property with bags for collecting municipal waste. The contractor is obliged to equip them with bags for selective waste collection free of charge. Waste disposal schedule. The contractor will submit a detailed schedule for the collection of mixed and segregated waste, with an indication of: the place and dates of collection of municipal waste. The Contracting Authority undertakes to publish the schedules on the Office's website. The Contractor will also be obliged to distribute the schedule accepted by the Contracting Authority among property owners and other documents related to the waste management system, unless they require confirmation of acceptance. Reporting. The Contractor is obliged to submit reports and reports to the Contracting Authority. The presented amounts of municipal waste are approximate. A detailed description of the subject matter of the contract is included in Appendix 8 - Detailed Description of the Subject of the Contract. Therefore, bidders are required to check the conditions of performance of the contract in great detail. Bidders are advised to read the Terms of Reference in detail, obtain all information necessary for the proper preparation of the offer, check and verify the documentation, and immediately inform the Contracting Authority of any errors or omissions. Information on entrusting the performance of a part of the contract by the Contractor to subcontractors: In such a case, the Contractor is obliged to indicate in the offer form the part of the contract that it intends to entrust to subcontractors. If the necessity to entrust subcontractors with the implementation of a certain element of the contract arose during the performance of the contract, it requires the written consent of the Contracting Authority. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires the Contractor or subcontractor to employ persons on the basis of an employment contract to perform the activities indicated by the Contracting Authority in the scope of contract performance, if the performance of these activities involves the performance of work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – the Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended), i.e. the activities of an employee responsible for the provision of services, i.e. authorised to drive vehicles, holding a category C or C+E driving licence, in accordance with the Act of 20 June 1997. This obligation also applies to subcontractors – the contractor is obliged to include in each subcontracting agreement appropriate provisions obliging subcontractors to employ all persons performing the above-mentioned activities under an employment contract. a) The Contracting Authority requires the submission of a written statement (list) of persons assigned to perform the contract employed under an employment contract within 5 days from the date of signing the contract, specifying the name and surname of the employee and the scope of activities. b) The requirement of employment under the employment contract referred to above must be met throughout the period of performance of the subject matter of the contract. c) In the event of a change in the number of persons employed during the performance of the subject matter of the contract, the Contractor is obliged to provide an up-to-date list within 5 working days from the date of making the changes d) Failure to submit the declarations specified in points a) and c) shall be treated as failure to fulfil the obligation to employ employees under an employment contract and shall be treated as failure to fulfil the obligation to employ employees under an employment contract and shall result in the calculation of penalties contractual agreements in the amount specified in the draft agreement attached to the Terms of Reference. e) In the event of reasonable doubts as to the compliance of the Contractor or Subcontractors with labour law.
