1.The subject of the contract is the delivery and installation of photovoltaic installations on the roofs of educational institutions of the Commune, along with partial reconstruction of the existing power supply installation, including the electricity metering and settlement system. The purpose of the investment is to cover the facility's own demand for electricity

2. The subject of the contract has been divided into 2 parts.

2.1.Part 1 order:D and installation of photovoltaic installations in the buildings of educational units for ZSS at Mikołaja 3,41-106 Siem-ce Śl (school building, swimming pool building).

2.2.Part 2 order:D and installation of photovoltaic installations in buildings of educational institutions for SPnr 20 im. Lipowa 3,41-100 Siem-ce Śl, ZSTiO MERITUM at Katowicka 1, 41-100 Siem-ce Śl. (school building), ZSOiZ W.Budryka 2, 41-103 Siem-ce Śl

1. The subject of the contract is the delivery and assembly of photovoltaic installations for the buildings of the Sports School Complex at Mikołaja 3, 41-106 Siemianowice Śląskie (school building, swimming pool building) along with partial reconstruction of the existing power supply installation, including the electricity metering and settlement system. On-grid photovoltaic installation generating electricity in the form of three-phase alternating current AC 230/400 V 50 Hz. The purpose of the investment is to cover the facility's own demand for electricity.

2.A detailed description of the subject of the contract is the Technical Report Appendix No. 4a to the SWZ concerning the implementation of the task "Regional Operational Programme Woj. Silesian Voivodeship 2014-2020 project title: Słoneczna Gmina – installation of photovoltaic installations

in public infrastructure II'

3. The Contractor is obliged to perform the contract on the terms and conditions described in the Draft provisions of the contract (Appendix No. 5a to the SWZ).

4. For the subject of the contract, the selected Contractor shall grant the Contracting entity a period of guarantee and warranty:

(a) for photovoltaic panels for a period consistent with the Contractor's offer, however, not less than 72 months;

(b) for linear power output of photovoltaic panels, i.e.: not less than 84% of initial efficiency after 25 years of use, warranty and warranty for a period of 25 years;

c) for an inverter for a period consistent with the Contractor's offer, but not shorter than 60 months;

(d) for the other supplied and mounted components and for the warranty and warranty assembly work carried out for a period of 72 months;

counting from the next day after the date of signing by the Contracting Authority and the Contractor. Final Receipt Protocol

5. The Contracting Authority has described the subject of the contract without indicating trademarks, patents or origin, source or specific process that characterizes the product or services provided by a specific Contractor. If the Contractor finds that the subject of the contract has been described in the manner referred to in Article 99(5) of the Act, i.e. the origin (brand, trademark, manufacturer, supplier) of the materials has been indicated, and the criteria used to assess equivalence have not been provided, it should ask the Contracting Authority to indicate what criteria will be used to assess equivalence. If the Detailed Description of the subject of the contract described in point 2 above contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the PPL, the Contracting Authority shall allow solutions equivalent to those described. The use of a given standard, technical assessment, technical specifications and technical reference system in the Detailed Description of the Subject of the Order is only intended to clarify the level of expectations of the Ordering Party in relation to a specific material/device/product.

6. If the documentation constituting a Detailed Description of the Subject of the Contract contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the PPL, the Contracting Authority shall allow solutions equivalent to those described. The use of a given standard, technical assessment, technical specifications and technical reference system in the documentation is only intended to clarify the level of expectations of the Ordering Party in relation to a specific material/device/product.
