The subject of the order is delivery along with assembly, commissioning and adaptation works of the osteopulmonary X-ray apparatus, CPV code: 33111000-1 - X-ray equipment with disassembly of the current apparatus, which should be stored in the place indicated by the Ordering Party. The subject of the contract is described and specified in Appendix No. 3 to the Technical Specification.

The subject of the order is delivery with assembly, commissioning and adaptation works of the osteopulmonary X-ray apparatus, CPV code: 33111000-1 - X-ray equipment with disassembly of the current apparatus, which should be stored in the place indicated by the Ordering Party. The subject of the contract has been described and specified in Appendix No. 3 of the Technical Specification
2. The place of delivery of the devices is SPZOZ in Łęczna,
3. The subject of the order is to be new, produced not earlier than in 2022, admitted to trading on the basis of applicable law and meet all requirements specified by law, in particular the Act of 7 April 2022
about medical devices (Journal of Laws of 2022, item 974) and free from any physical or legal defects
4. All the listed items shall be offered as part of the kit. Failure to fill in any item within the set will result in the rejection of the offer.
5. The technical parameters given in the Annexes shall be considered as a model satisfying the minimum requirements. The elements proposed by the Contractors may not have parameters worse than those given as a model.
6. Whenever trademarks, patents, origin, standards, approvals, technical specifications and technical reference systems are indicated in the description of the subject of the contract. Equivalence lies in the ability to offer an order item with no inferior technical parameters, configurations, normative requirements, etc.
7. The Contractor undertakes, during the warranty period for the equipment to which the warranty applies and has been entered in the technical specification, to provide maintenance, validation and warranty services of the subject of delivery in accordance with the manufacturer's recommendation without incurring costs by the Ordering Party for a minimum period of 24 months, while the minimum warranty conditions must meet the conditions set out in the technical specification constituting Annex 10 to the SWZ.
8. The date of payment is up to 60 days from the date of receipt of the invoice correctly issued.
9. The Ordering Party allows sending an invoice by fax or e-mail and immediately sending the original by post as well as sending structured electronic invoices in accordance with the Act of 9 November 2018 on electronic invoicing in public procurement, concessions for construction works or services and public-private partnership (Journal of Laws of 2018, item 2191).
10. The order is carried out from the funds of the COVID-19 Prevention Fund.
11. Information on the prior evaluation of tenders, in accordance with Article 139 of the Public Procurement Law, the selection of the most advantageous offer will be made using the so-called "reverse procedure". The contracting authority will first examine and evaluate the tenders, and then make a subjective qualification of contractors whose tenders have been rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
12. The Ordering Party does not allow the possibility of submitting partial offers.
Rationale: The purchase of a bone-pulmonary X-ray machine is an indivisible order. The ordering party wants to achieve economies of scale. The decision not to divide the contract into lots is economically justified. In addition, there is no risk of breaching the principle of fair competition. The offer may be submitted by any Contractor who meets the conditions for participation in the procedure. The subject of the contract is standardized, identical and regardless of which of the Contractors performs it, the only difference will be the price offered. The absence of a division into parts of the present proceedings does not limit the participation of the small and medium-sized enterprise sector.
